國務院辦公廳關(guan)于深入推進跨部門綜合(he)監管的指導意見
國辦發(fa)〔2023〕1號
各省、自治(zhi)區、直轄市人民政(zheng)府,國(guo)務院(yuan)各部委、各直屬機構:
深入(ru)推(tui)進(jin)(jin)跨部門綜合監管(guan),是加快(kuai)轉(zhuan)變政府職能(neng)、提高政府監管(guan)效能(neng)的重要舉措。近年來,各地區(qu)(qu)各部門認真貫徹落實黨中央、國務(wu)院決策部署,著(zhu)力加強和創(chuang)新監管(guan),取(qu)得(de)積(ji)極成效,但一(yi)些地區(qu)(qu)一(yi)些領域(yu)仍然存在監管(guan)責任不明確(que)、協同機制(zhi)不完(wan)善(shan)、風險防范(fan)能(neng)力不強以及重復檢查、多頭執(zhi)法等(deng)問題。為進(jin)(jin)一(yi)步加強跨部門綜合監管(guan),維護(hu)公(gong)平有序的市(shi)場(chang)環境,切實降低(di)市(shi)場(chang)主體制(zhi)度性交易成本,推(tui)動高質量發(fa)展,經國務(wu)院同意,現(xian)提出如(ru)下意見。
一、總體要求
(一)指導思想。以習近平(ping)新(xin)時代(dai)中國特色社會(hui)主義思想為指導(dao),深(shen)入貫徹落實(shi)黨的(de)二十大精(jing)神,完整(zheng)、準(zhun)確(que)、全(quan)面貫徹新(xin)發(fa)展(zhan)(zhan)理(li)念,加(jia)快構建新(xin)發(fa)展(zhan)(zhan)格局,堅(jian)持(chi)統籌(chou)發(fa)展(zhan)(zhan)和安全(quan),健全(quan)監(jian)(jian)管體制(zhi)機(ji)制(zhi),完善監(jian)(jian)管制(zhi)度框架,創新(xin)監(jian)(jian)管方(fang)式方(fang)法,對涉及(ji)多個部門(men)、管理(li)難(nan)度大、風險(xian)隱患突出的(de)監(jian)(jian)管事項(xiang),建立健全(quan)跨部門(men)綜合(he)監(jian)(jian)管制(zhi)度,強化條塊結合(he)、區域(yu)聯動,完善協同監(jian)(jian)管機(ji)制(zhi),提升監(jian)(jian)管的(de)精(jing)準(zhun)性和有(you)效性,維(wei)護公平(ping)競(jing)爭的(de)市(shi)場秩序,為加(jia)快建設(she)全(quan)國統一大市(shi)場、推動高質(zhi)量發(fa)展(zhan)(zhan)提供有(you)力支撐。
(二(er))基本原(yuan)則(ze)。
堅(jian)持系統(tong)觀念、統(tong)籌推進(jin)。加(jia)(jia)強(qiang)整(zheng)體(ti)設(she)計(ji),一體(ti)推進(jin)監管體(ti)制機制建設(she),統(tong)籌各類監管資源,加(jia)(jia)快建立全方位、多層次(ci)、立體(ti)化(hua)監管體(ti)系,實現(xian)事前事中事后全鏈條(tiao)全領(ling)域(yu)監管。
堅持協同(tong)聯動、務(wu)實高效。聚焦具體監(jian)管事項,逐項理(li)清責(ze)任(ren)鏈(lian)條,明(ming)確責(ze)任(ren)分工,加強(qiang)跨部門、跨區(qu)域、跨層級業(ye)務(wu)協同(tong),切實增強(qiang)監(jian)管合力,提高綜合監(jian)管效能。
堅持(chi)問題導向、突出(chu)重(zhong)點。聚(ju)焦(jiao)監管薄弱環節(jie),加快完善(shan)風(feng)險隱患(huan)突出(chu)的重(zhong)點領域、新(xin)興領域跨部門綜合監管制度(du),補齊(qi)監管短(duan)板、堵(du)塞監管漏(lou)洞(dong),切實把該管的管好(hao)、管到位。
堅持創(chuang)新(xin)驅動(dong)、數(shu)字(zi)賦能。創(chuang)新(xin)監管理念(nian)和方法,結合(he)跨部(bu)門綜合(he)監管事項(xiang)風險特點,加強信(xin)息技術運用(yong),統籌推(tui)進業務(wu)融合(he)、數(shu)據融合(he)、技術融合(he),實施精準有(you)效監管。
(三)主要目標。2023年(nian)(nian)底前,建立跨部(bu)門(men)(men)綜(zong)合(he)(he)監管重點事項清單(dan)管理和動(dong)態更(geng)新機制(zhi)(zhi),在部(bu)分領域開展跨部(bu)門(men)(men)綜(zong)合(he)(he)監管試點,按事項建立健(jian)全跨部(bu)門(men)(men)綜(zong)合(he)(he)監管制(zhi)(zhi)度(du),完善各司其職(zhi)、各負其責、相互配合(he)(he)、齊抓共管的協(xie)同監管機制(zhi)(zhi)。到2025年(nian)(nian),在更(geng)多(duo)領域、更(geng)大范圍建立健(jian)全跨部(bu)門(men)(men)綜(zong)合(he)(he)監管制(zhi)(zhi)度(du),進一步優化協(xie)同監管機制(zhi)(zhi)和方(fang)式,大幅提(ti)升發現問題(ti)和處置風險能力,推動(dong)市(shi)場競爭(zheng)更(geng)加公平有序、市(shi)場活力充分釋放。
二、健(jian)全(quan)跨部(bu)門綜合監管體制機制
(四)確(que)定跨部門綜(zong)合監(jian)管事項清單。行業主(zhu)管(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)或法律法規(gui)規(gui)定的主(zhu)管(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)(以(yi)下統(tong)稱(cheng)行業主(zhu)管(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men))要會(hui)同(tong)相關(guan)監(jian)(jian)管(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)梳(shu)理(li)需實(shi)施跨部(bu)(bu)門(men)(men)(men)綜(zong)合(he)監(jian)(jian)管(guan)(guan)(guan)(guan)的重(zhong)點事項,對食品、藥品、醫療(liao)器(qi)械、危險化學品、燃(ran)氣(qi)、特(te)種設備、建(jian)筑工程質(zhi)量、非法金(jin)融活動等直(zhi)接關(guan)系(xi)人民群眾生命財產安全(quan)、公共安全(quan)和(he)潛在風(feng)險大、社會(hui)風(feng)險高的重(zhong)點領(ling)域及新興領(ling)域中涉及多部(bu)(bu)門(men)(men)(men)監(jian)(jian)管(guan)(guan)(guan)(guan)的事項,要積極開(kai)展跨部(bu)(bu)門(men)(men)(men)綜(zong)合(he)監(jian)(jian)管(guan)(guan)(guan)(guan)。各省(自治區、直(zhi)轄市)要明確(que)本(ben)地區跨部(bu)(bu)門(men)(men)(men)綜(zong)合(he)監(jian)(jian)管(guan)(guan)(guan)(guan)重(zhong)點事項。2023年底(di)前,各地區各部(bu)(bu)門(men)(men)(men)通過“互聯網+監(jian)(jian)管(guan)(guan)(guan)(guan)”系(xi)統(tong)對跨部(bu)(bu)門(men)(men)(men)綜(zong)合(he)監(jian)(jian)管(guan)(guan)(guan)(guan)重(zhong)點事項實(shi)施清單管(guan)(guan)(guan)(guan)理(li)和(he)動態更新。
(五)明確(que)跨(kua)部門綜合(he)監管責任分(fen)工。行(xing)業(ye)主(zhu)管(guan)(guan)(guan)部(bu)(bu)門要(yao)(yao)會同(tong)(tong)相(xiang)關(guan)監管(guan)(guan)(guan)部(bu)(bu)門依照法律法規、“三(san)定”規定和權責(ze)(ze)清單(dan),逐項(xiang)明確(que)跨部(bu)(bu)門綜合(he)監管(guan)(guan)(guan)事(shi)(shi)項(xiang)責(ze)(ze)任(ren)分工。對行(xing)業(ye)主(zhu)管(guan)(guan)(guan)部(bu)(bu)門不明確(que)、監管(guan)(guan)(guan)邊界模糊、監管(guan)(guan)(guan)責(ze)(ze)任(ren)存在(zai)爭議(yi)的(de)(de)新(xin)產(chan)業(ye)新(xin)業(ye)態新(xin)模式(shi),與之相(xiang)關(guan)的(de)(de)各(ge)部(bu)(bu)門都要(yao)(yao)主(zhu)動履職、密切配合(he),防止(zhi)出(chu)現監管(guan)(guan)(guan)空白;同(tong)(tong)時,要(yao)(yao)按照領域歸口、業(ye)務相(xiang)近(jin)原則和新(xin)產(chan)業(ye)新(xin)業(ye)態新(xin)模式(shi)的(de)(de)主(zhu)要(yao)(yao)行(xing)為特征,會同(tong)(tong)有(you)關(guan)方(fang)面及(ji)時對其研判定性(xing)、明確(que)監管(guan)(guan)(guan)職責(ze)(ze)。縣(xian)級(ji)以(yi)上(shang)地方(fang)人民政府要(yao)(yao)全面落實屬地監管(guan)(guan)(guan)責(ze)(ze)任(ren),對本地區涉及(ji)多部(bu)(bu)門監管(guan)(guan)(guan)的(de)(de)事(shi)(shi)項(xiang),要(yao)(yao)結合(he)地方(fang)機構(gou)設置和監管(guan)(guan)(guan)力(li)量配置等情況確(que)定監管(guan)(guan)(guan)部(bu)(bu)門和職責(ze)(ze)劃(hua)分,確(que)保事(shi)(shi)有(you)人管(guan)(guan)(guan)、責(ze)(ze)有(you)人負。對存在(zai)部(bu)(bu)門管(guan)(guan)(guan)轄爭議(yi)的(de)(de)行(xing)政執法事(shi)(shi)項(xiang),各(ge)級(ji)司法行(xing)政部(bu)(bu)門要(yao)(yao)加(jia)強(qiang)協調。
(六(liu))完善(shan)跨部(bu)門綜合監管制度規則。各地(di)(di)區(qu)各部(bu)(bu)門(men)(men)要(yao)強化監(jian)(jian)(jian)(jian)管(guan)(guan)政策(ce)的協同性、有效性和可操作(zuo)性,既(ji)要(yao)防止出(chu)現(xian)監(jian)(jian)(jian)(jian)管(guan)(guan)漏洞,又要(yao)避免政策(ce)疊加(jia)造(zao)成不(bu)利(li)影響(xiang)。行業主管(guan)(guan)部(bu)(bu)門(men)(men)要(yao)會同相關監(jian)(jian)(jian)(jian)管(guan)(guan)部(bu)(bu)門(men)(men)加(jia)快推進跨(kua)部(bu)(bu)門(men)(men)綜合監(jian)(jian)(jian)(jian)管(guan)(guan)制(zhi)度(du)(du)建設,明確牽(qian)頭單(dan)位(wei)、配(pei)合單(dan)位(wei)、監(jian)(jian)(jian)(jian)管(guan)(guan)規(gui)則(ze)和標準等,完善配(pei)套(tao)監(jian)(jian)(jian)(jian)管(guan)(guan)措(cuo)施;對現(xian)行監(jian)(jian)(jian)(jian)管(guan)(guan)標準不(bu)一致、相互(hu)不(bu)銜接(jie)的制(zhi)度(du)(du)規(gui)則(ze),要(yao)抓緊修訂完善。支(zhi)持各地(di)(di)區(qu)實(shi)施綜合監(jian)(jian)(jian)(jian)管(guan)(guan)“一業一冊”告知制(zhi)度(du)(du),一類(lei)事項(xiang)制(zhi)定(ding)一冊合規(gui)經營(ying)指南,一次(ci)性告知市(shi)場主體合規(gui)經營(ying)要(yao)求,穩(wen)定(ding)市(shi)場主體監(jian)(jian)(jian)(jian)管(guan)(guan)預期(qi)。
(七(qi))健全跨部(bu)門綜合監管工作(zuo)機制。行(xing)業主(zhu)管部(bu)(bu)(bu)門要(yao)會(hui)(hui)同相(xiang)關監(jian)管部(bu)(bu)(bu)門根據(ju)監(jian)管需要(yao),建(jian)立(li)健全協同高效(xiao)的(de)(de)跨部(bu)(bu)(bu)門綜合(he)(he)監(jian)管工作(zuo)(zuo)(zuo)機(ji)制(zhi),明確(que)議事會(hui)(hui)商(shang)、情況通報(bao)等工作(zuo)(zuo)(zuo)要(yao)求,有(you)效(xiao)整合(he)(he)監(jian)管資(zi)源,統籌監(jian)管政策制(zhi)定,督促監(jian)管責任落實,推動監(jian)管信息共(gong)享,組織聯(lian)合(he)(he)執法檢查(cha)。已建(jian)立(li)相(xiang)關工作(zuo)(zuo)(zuo)機(ji)制(zhi)的(de)(de),要(yao)進(jin)一(yi)步完善(shan)運行(xing)規則(ze),加(jia)強業務統籌,強化跨部(bu)(bu)(bu)門綜合(he)(he)監(jian)管職能作(zuo)(zuo)(zuo)用。縣級以上地方人民政府(fu)要(yao)結合(he)(he)區域實際(ji),分事項建(jian)立(li)健全相(xiang)關跨部(bu)(bu)(bu)門綜合(he)(he)監(jian)管工作(zuo)(zuo)(zuo)機(ji)制(zhi),加(jia)強統籌協調,推動解決突出問題,防范化解重大風(feng)險(xian)。
三、完善跨(kua)部門綜合(he)監管(guan)協(xie)同方式
(八)加強風(feng)險隱患跨部(bu)門聯(lian)合監測。聚焦問題多發(fa)和(he)高風(feng)(feng)險領域,構建(jian)科學高效、多部(bu)門聯動響應的風(feng)(feng)險隱(yin)患(huan)監(jian)(jian)(jian)測(ce)預警(jing)(jing)機制(zhi),實現(xian)風(feng)(feng)險隱(yin)患(huan)動態監(jian)(jian)(jian)測(ce)、科學評估、精(jing)準預警(jing)(jing)和(he)及時處置(zhi)。要(yao)依托“互聯網+監(jian)(jian)(jian)管”等現(xian)有信(xin)息(xi)(xi)系統,針(zhen)對(dui)具體(ti)監(jian)(jian)(jian)管事(shi)項的風(feng)(feng)險特(te)點,構建(jian)跨(kua)部(bu)門聯合監(jian)(jian)(jian)測(ce)預警(jing)(jing)模型,建(jian)立健全預警(jing)(jing)指(zhi)標(biao)(biao)體(ti)系和(he)預警(jing)(jing)標(biao)(biao)準,明確預警(jing)(jing)信(xin)息(xi)(xi)推送(song)規(gui)則,制(zhi)定預警(jing)(jing)響應和(he)處置(zhi)預案。要(yao)利用信(xin)息(xi)(xi)技(ji)術手段全面(mian)提升監(jian)(jian)(jian)測(ce)感知能力(li),有效歸集分析相(xiang)關部(bu)門監(jian)(jian)(jian)管信(xin)息(xi)(xi),及早發(fa)現(xian)和(he)處置(zhi)各類風(feng)(feng)險隱(yin)患(huan)。對(dui)重大預警(jing)(jing)信(xin)息(xi)(xi)要(yao)開展(zhan)跨(kua)部(bu)門綜合研(yan)判(pan)、協同處置(zhi)。
(九)開展市場主體跨部門聯合(he)抽(chou)查檢查。高效統籌監(jian)管執法資源,大力精(jing)簡整合檢(jian)(jian)查(cha)(cha)(cha)事項,積極推(tui)行(xing)聯(lian)(lian)合抽(chou)查(cha)(cha)(cha)檢(jian)(jian)查(cha)(cha)(cha),持續提(ti)升協(xie)同(tong)監(jian)管能力。兩(liang)個(ge)以(yi)(yi)上部門(men)對同(tong)一(yi)監(jian)管對象實(shi)施不同(tong)行(xing)政檢(jian)(jian)查(cha)(cha)(cha)且可以(yi)(yi)同(tong)時(shi)開(kai)展的,原則上應(ying)實(shi)行(xing)跨(kua)部門(men)聯(lian)(lian)合檢(jian)(jian)查(cha)(cha)(cha)。開(kai)展跨(kua)部門(men)聯(lian)(lian)合抽(chou)查(cha)(cha)(cha)檢(jian)(jian)查(cha)(cha)(cha)一(yi)般應(ying)采(cai)取“雙隨機、一(yi)公開(kai)”監(jian)管方式,要結(jie)合監(jian)管對象信用等級和風險(xian)分類,不斷優化組(zu)(zu)織方式,合理確(que)定抽(chou)查(cha)(cha)(cha)比例(li)、頻次和參與(yu)部門(men)等。發現涉及行(xing)業性(xing)、區域(yu)性(xing)違法違規行(xing)為或(huo)存在普(pu)遍性(xing)、多(duo)發性(xing)問題的,應(ying)及時(shi)組(zu)(zu)織開(kai)展跨(kua)部門(men)聯(lian)(lian)合檢(jian)(jian)查(cha)(cha)(cha)或(huo)專(zhuan)項整治。
(十(shi))推進(jin)問題(ti)線索跨部門聯合(he)處置。不斷拓(tuo)寬問題線(xian)索(suo)(suo)收(shou)集渠(qu)道,通過12345政務服務便民熱線(xian)、全(quan)國一體(ti)化(hua)在(zai)線(xian)監(jian)管(guan)平(ping)臺以及(ji)行(xing)業協會(hui)、新(xin)聞媒(mei)體(ti)等(deng)多(duo)(duo)種渠(qu)道廣泛收(shou)集問題線(xian)索(suo)(suo),加強大數據分析,形(xing)成(cheng)社(she)會(hui)多(duo)(duo)元共治合力。建立健全(quan)問題線(xian)索(suo)(suo)分辦、轉辦和查(cha)(cha)處(chu)(chu)工(gong)(gong)作(zuo)機制(zhi),對涉及(ji)多(duo)(duo)部門監(jian)管(guan)職(zhi)(zhi)責的問題線(xian)索(suo)(suo),及(ji)時轉送(song)相(xiang)關(guan)部門協同開展核查(cha)(cha),依(yi)(yi)法(fa)依(yi)(yi)規進(jin)(jin)行(xing)處(chu)(chu)理(li),既(ji)要做到應(ying)查(cha)(cha)必查(cha)(cha)、有效處(chu)(chu)置,又(you)要防(fang)止多(duo)(duo)頭檢查(cha)(cha)、重(zhong)復處(chu)(chu)罰。各部門在(zai)工(gong)(gong)作(zuo)中發現屬于其他部門監(jian)管(guan)職(zhi)(zhi)責的違(wei)法(fa)違(wei)規行(xing)為,要及(ji)時將線(xian)索(suo)(suo)等(deng)推送(song)給(gei)相(xiang)關(guan)部門,相(xiang)關(guan)部門要及(ji)時進(jin)(jin)行(xing)調(diao)查(cha)(cha)處(chu)(chu)理(li)。
(十一)積極開展跨部(bu)門聯合信用監管。根(gen)據跨部(bu)(bu)門(men)綜(zong)合(he)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)對象的(de)(de)(de)屬性和風險特點(dian),積極探索符(fu)合(he)行業監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)需(xu)要(yao)的(de)(de)(de)信(xin)用(yong)(yong)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)模(mo)式,充(chong)分(fen)發揮信(xin)用(yong)(yong)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)在配置監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)資源、防范(fan)化解風險等方面的(de)(de)(de)重要(yao)作(zuo)用(yong)(yong)。行業主管(guan)(guan)部(bu)(bu)門(men)要(yao)會同相(xiang)關監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)部(bu)(bu)門(men)建立(li)健全跨部(bu)(bu)門(men)綜(zong)合(he)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)事項信(xin)用(yong)(yong)評(ping)價指標體系(xi),明(ming)確(que)分(fen)級分(fen)類標準(zhun)及相(xiang)應的(de)(de)(de)協(xie)同監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)措施。相(xiang)關部(bu)(bu)門(men)在注冊(ce)登記、資質(zhi)審核、日常(chang)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)、公共服(fu)務、執法(fa)辦案過程(cheng)中,要(yao)準(zhun)確(que)、全面記錄市場主體信(xin)用(yong)(yong)行為,及時(shi)歸集共享信(xin)用(yong)(yong)信(xin)息。發現存在違法(fa)失(shi)信(xin)行為的(de)(de)(de),要(yao)及時(shi)通(tong)報相(xiang)關部(bu)(bu)門(men),依法(fa)開展失(shi)信(xin)懲(cheng)戒。
四、提升跨部(bu)門綜合監(jian)管聯動(dong)效能
(十二)加強(qiang)部(bu)門與地方監管聯動(dong)。各部(bu)門(men)(men)制定監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)政(zheng)策要充(chong)分聽取地方(fang)的意見(jian)建議(yi);加強(qiang)對(dui)地方(fang)的業務指導,全面研判風險隱患,督促相(xiang)關(guan)地區(qu)(qu)(qu)彌補(bu)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)短板;建立監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)資(zi)源(yuan)統籌調(diao)(diao)配機(ji)制,對(dui)需(xu)要調(diao)(diao)用異地監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)執(zhi)法資(zi)源(yuan)處置違(wei)法違(wei)規問題(ti)以(yi)及有關(guan)地區(qu)(qu)(qu)提出(chu)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)協(xie)助(zhu)需(xu)要的,及時協(xie)調(diao)(diao)開展跨(kua)區(qu)(qu)(qu)域(yu)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)執(zhi)法。垂直(zhi)管(guan)(guan)(guan)(guan)(guan)理部(bu)門(men)(men)要加強(qiang)與(yu)地方(fang)政(zheng)府(fu)之間的信息(xi)共(gong)(gong)享和(he)執(zhi)法協(xie)作。各地區(qu)(qu)(qu)要加強(qiang)與(yu)相(xiang)關(guan)部(bu)門(men)(men)的溝通(tong)聯系(xi),及時分析本地區(qu)(qu)(qu)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)突出(chu)問題(ti),對(dui)本地區(qu)(qu)(qu)跨(kua)部(bu)門(men)(men)綜合(he)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)事項實(shi)施有效監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan);有效整合(he)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)資(zi)源(yuan),及時共(gong)(gong)享監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)信息(xi),支持和(he)配合(he)有關(guan)部(bu)門(men)(men)開展跨(kua)區(qu)(qu)(qu)域(yu)、跨(kua)層級監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)工(gong)作。
(十三)加(jia)強跨區(qu)域監管聯動。針對跨(kua)(kua)部門綜合監管(guan)(guan)涉及的跨(kua)(kua)區(qu)域監管(guan)(guan)缺(que)位(wei)、管(guan)(guan)轄爭議、執法辦案困難等問題,建(jian)立(li)健(jian)全(quan)源頭追(zhui)溯、信(xin)息共(gong)享、線索(suo)移送、聯合調查、執法聯動、執法互認等機制。加(jia)(jia)快推進(jin)食品安全(quan)、道(dao)路運輸安全(quan)、知識產(chan)權保護、資(zi)質資(zi)格認定、商業特(te)許經營等跨(kua)(kua)區(qu)域監管(guan)(guan)協(xie)作(zuo),切實(shi)加(jia)(jia)強(qiang)大氣污染(ran)(ran)、水污染(ran)(ran)、固體廢物(wu)轉移等跨(kua)(kua)區(qu)域聯防聯治。鼓(gu)勵跨(kua)(kua)行政(zheng)區(qu)域按(an)規(gui)定聯合發布統(tong)一監管(guan)(guan)政(zheng)策法規(gui)及區(qu)域性地(di)方(fang)標準,加(jia)(jia)強(qiang)調查取證(zheng)和案件處置合作(zuo),京津冀、長(chang)三角(jiao)、粵港澳大灣區(qu)、成(cheng)渝(yu)等地(di)區(qu)要積極探索(suo)創新聯合監管(guan)(guan)模(mo)式。
(十四)加(jia)強(qiang)行(xing)政執法與刑(xing)事司(si)法聯動。行政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)機(ji)(ji)(ji)(ji)關(guan)(guan)要(yao)與司法(fa)(fa)(fa)(fa)(fa)機(ji)(ji)(ji)(ji)關(guan)(guan)加強信(xin)息共享(xiang)、線索移送、聯(lian)合(he)調(diao)(diao)查等(deng)(deng)(deng)方面協調(diao)(diao)配(pei)合(he),建立健全行刑銜(xian)接(jie)機(ji)(ji)(ji)(ji)制(zhi)。根據不(bu)同領域監管實(shi)際需(xu)要(yao),完善案件移送、雙(shuang)向咨詢、情(qing)況通(tong)報(bao)、信(xin)息共享(xiang)、檢(jian)驗鑒定(ding)結果互(hu)認等(deng)(deng)(deng)機(ji)(ji)(ji)(ji)制(zhi)。行政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)機(ji)(ji)(ji)(ji)關(guan)(guan)在(zai)依(yi)法(fa)(fa)(fa)(fa)(fa)查處(chu)(chu)違法(fa)(fa)(fa)(fa)(fa)行為過程中(zhong)發現涉(she)嫌犯罪(zui)、依(yi)法(fa)(fa)(fa)(fa)(fa)需(xu)要(yao)追究刑事責(ze)任的(de),應及時移送有(you)關(guan)(guan)機(ji)(ji)(ji)(ji)關(guan)(guan)處(chu)(chu)理(li);存(cun)在(zai)暴(bao)力(li)抗法(fa)(fa)(fa)(fa)(fa)等(deng)(deng)(deng)情(qing)形的(de),可商請有(you)關(guan)(guan)機(ji)(ji)(ji)(ji)關(guan)(guan)協助調(diao)(diao)查處(chu)(chu)理(li)。有(you)關(guan)(guan)機(ji)(ji)(ji)(ji)關(guan)(guan)立案后提請行政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)機(ji)(ji)(ji)(ji)關(guan)(guan)作(zuo)出檢(jian)驗、鑒定(ding)、認定(ding)和涉(she)案物品保存(cun)、銷(xiao)毀、處(chu)(chu)置等(deng)(deng)(deng)協助的(de),行政(zheng)執(zhi)法(fa)(fa)(fa)(fa)(fa)機(ji)(ji)(ji)(ji)關(guan)(guan)要(yao)積(ji)極(ji)配(pei)合(he)。
