國(guo)務院辦公(gong)廳(ting)關于深(shen)入推進(jin)跨部門(men)綜合(he)監管的(de)指(zhi)導意見

各省(sheng)、自治區、直轄(xia)市人民政府,國務院各部委、各直屬機構:
深入推進跨部門綜(zong)合監管(guan),是(shi)加快(kuai)轉變政府職能(neng)、提(ti)高(gao)政府監管(guan)效(xiao)能(neng)的重要舉措(cuo)。近(jin)年(nian)來,各地區(qu)各部門認(ren)真(zhen)貫徹落(luo)實(shi)黨中央(yang)、國(guo)務院(yuan)決策(ce)部署,著力(li)加強和(he)創新(xin)監管(guan),取得(de)積極成效(xiao),但一(yi)些(xie)地區(qu)一(yi)些(xie)領域仍(reng)然存在監管(guan)責(ze)任不(bu)明確、協同(tong)機制不(bu)完善(shan)、風險防范能(neng)力(li)不(bu)強以及(ji)重復檢(jian)查、多頭執(zhi)法等問題(ti)。為進一(yi)步加強跨部門綜(zong)合監管(guan),維護(hu)公平有序的市場(chang)環(huan)境(jing),切實(shi)降低市場(chang)主體(ti)制度性交(jiao)易成本,推動(dong)高(gao)質(zhi)量(liang)發(fa)展,經國(guo)務院(yuan)同(tong)意,現提(ti)出如(ru)下(xia)意見。
一、總(zong)體要求
(一)指導思想(xiang)。以(yi)習近平(ping)新時代中(zhong)國特色(se)社會主(zhu)義思想(xiang)為指導,深入貫徹落實(shi)黨的(de)(de)二十大(da)(da)精神,完(wan)整、準(zhun)確(que)、全面貫徹新發(fa)展理念,加快構建新發(fa)展格局,堅持統籌(chou)發(fa)展和(he)安全,健(jian)全監(jian)(jian)管(guan)(guan)(guan)體制(zhi)(zhi)機制(zhi)(zhi),完(wan)善監(jian)(jian)管(guan)(guan)(guan)制(zhi)(zhi)度(du)框架,創新監(jian)(jian)管(guan)(guan)(guan)方式方法,對涉及多個(ge)部門、管(guan)(guan)(guan)理難度(du)大(da)(da)、風險隱(yin)患突(tu)出的(de)(de)監(jian)(jian)管(guan)(guan)(guan)事項,建立健(jian)全跨部門綜(zong)合監(jian)(jian)管(guan)(guan)(guan)制(zhi)(zhi)度(du),強化(hua)條塊(kuai)結合、區域(yu)聯動,完(wan)善協同(tong)監(jian)(jian)管(guan)(guan)(guan)機制(zhi)(zhi),提升監(jian)(jian)管(guan)(guan)(guan)的(de)(de)精準(zhun)性和(he)有效性,維護公(gong)平(ping)競爭(zheng)的(de)(de)市場秩序,為加快建設全國統一大(da)(da)市場、推(tui)動高質(zhi)量(liang)發(fa)展提供(gong)有力支撐。
(二(er))基本原則。
堅持(chi)系統觀念、統籌推進。加(jia)強(qiang)整(zheng)體設(she)計,一體推進監(jian)管體制機制建設(she),統籌各(ge)類監(jian)管資源,加(jia)快建立全(quan)(quan)方位、多層次、立體化(hua)監(jian)管體系,實(shi)現事(shi)前事(shi)中事(shi)后全(quan)(quan)鏈條全(quan)(quan)領域監(jian)管。
堅持協(xie)同聯動、務實高效(xiao)。聚(ju)焦具體監管事項,逐項理清責(ze)任鏈條,明確責(ze)任分工(gong),加強跨(kua)部門、跨(kua)區(qu)域、跨(kua)層(ceng)級業務協(xie)同,切(qie)實增強監管合(he)力,提(ti)高綜(zong)合(he)監管效(xiao)能。
堅持問題導向、突(tu)出重(zhong)點。聚焦(jiao)監管薄(bo)弱環節(jie),加快完善風(feng)險隱患突(tu)出的重(zhong)點領域、新興領域跨部門綜(zong)合(he)監管制度(du),補(bu)齊監管短板、堵塞監管漏洞(dong),切實把該管的管好、管到位(wei)。
堅持創新(xin)驅動、數字賦能。創新(xin)監(jian)管(guan)理念和方法(fa),結(jie)合(he)跨部(bu)門綜合(he)監(jian)管(guan)事項風(feng)險(xian)特點,加強信息技術運用,統籌推進業(ye)務(wu)融合(he)、數據融合(he)、技術融合(he),實施精準有效監(jian)管(guan)。
(三)主要目(mu)標(biao)。2023年底前,建(jian)立跨(kua)部(bu)門綜(zong)(zong)合(he)監(jian)管(guan)(guan)重點事項(xiang)清單管(guan)(guan)理(li)和動(dong)態(tai)更(geng)(geng)新機制(zhi)(zhi),在部(bu)分領域(yu)開(kai)展跨(kua)部(bu)門綜(zong)(zong)合(he)監(jian)管(guan)(guan)試點,按(an)事項(xiang)建(jian)立健全跨(kua)部(bu)門綜(zong)(zong)合(he)監(jian)管(guan)(guan)制(zhi)(zhi)度,完善(shan)各(ge)司其(qi)職(zhi)、各(ge)負其(qi)責、相互配合(he)、齊(qi)抓(zhua)共管(guan)(guan)的協同(tong)監(jian)管(guan)(guan)機制(zhi)(zhi)。到2025年,在更(geng)(geng)多領域(yu)、更(geng)(geng)大(da)范圍建(jian)立健全跨(kua)部(bu)門綜(zong)(zong)合(he)監(jian)管(guan)(guan)制(zhi)(zhi)度,進(jin)一步(bu)優(you)化(hua)協同(tong)監(jian)管(guan)(guan)機制(zhi)(zhi)和方式(shi),大(da)幅提升發現(xian)問題和處置風險(xian)能力,推動(dong)市(shi)場(chang)競爭更(geng)(geng)加公平有(you)序、市(shi)場(chang)活力充分釋(shi)放(fang)。
二(er)、健全跨部門綜(zong)合監管體(ti)制機制
(四)確定跨部門綜合(he)監(jian)管事項清單。行(xing)業主(zhu)管(guan)(guan)(guan)(guan)部(bu)門(men)(men)或法律法規規定的(de)主(zhu)管(guan)(guan)(guan)(guan)部(bu)門(men)(men)(以(yi)下統稱行(xing)業主(zhu)管(guan)(guan)(guan)(guan)部(bu)門(men)(men))要(yao)會同相(xiang)關監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)部(bu)門(men)(men)梳理需(xu)實施(shi)跨(kua)部(bu)門(men)(men)綜合監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)重(zhong)(zhong)點事項(xiang),對食品、藥品、醫療器械、危(wei)險(xian)(xian)化學(xue)品、燃氣、特種設備、建筑工程質量、非法金融活(huo)動等(deng)直接(jie)關系人民群眾生(sheng)命財產安(an)全(quan)、公(gong)共安(an)全(quan)和(he)(he)潛在風(feng)險(xian)(xian)大(da)、社會風(feng)險(xian)(xian)高的(de)重(zhong)(zhong)點領域及新(xin)興領域中(zhong)涉及多(duo)部(bu)門(men)(men)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)事項(xiang),要(yao)積極開展(zhan)跨(kua)部(bu)門(men)(men)綜合監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)。各省(自治區(qu)、直轄(xia)市)要(yao)明確本地(di)區(qu)跨(kua)部(bu)門(men)(men)綜合監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)重(zhong)(zhong)點事項(xiang)。2023年底前,各地(di)區(qu)各部(bu)門(men)(men)通過“互聯網+監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)”系統對跨(kua)部(bu)門(men)(men)綜合監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)重(zhong)(zhong)點事項(xiang)實施(shi)清單(dan)管(guan)(guan)(guan)(guan)理和(he)(he)動態更新(xin)。
(五)明(ming)確跨部門綜合監管責(ze)任分工。行(xing)業(ye)主(zhu)管(guan)(guan)(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)要(yao)(yao)會同(tong)相關(guan)監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)依照法(fa)律法(fa)規、“三定”規定和權責(ze)清單,逐項明確跨(kua)部(bu)(bu)門(men)(men)(men)綜(zong)合(he)(he)監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)事項責(ze)任分(fen)工(gong)。對行(xing)業(ye)主(zhu)管(guan)(guan)(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)不明確、監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)邊界模糊、監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)責(ze)任存在爭議的(de)(de)新(xin)產(chan)業(ye)新(xin)業(ye)態新(xin)模式(shi),與之相關(guan)的(de)(de)各部(bu)(bu)門(men)(men)(men)都要(yao)(yao)主(zhu)動履職(zhi)、密(mi)切配(pei)合(he)(he),防止出現監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)空白;同(tong)時(shi),要(yao)(yao)按(an)照領域歸口、業(ye)務相近原則和新(xin)產(chan)業(ye)新(xin)業(ye)態新(xin)模式(shi)的(de)(de)主(zhu)要(yao)(yao)行(xing)為特征,會同(tong)有關(guan)方(fang)(fang)面及時(shi)對其研(yan)判(pan)定性(xing)、明確監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)職(zhi)責(ze)。縣級(ji)以上地方(fang)(fang)人(ren)民(min)政府(fu)要(yao)(yao)全面落實屬地監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)責(ze)任,對本(ben)地區涉及多部(bu)(bu)門(men)(men)(men)監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)的(de)(de)事項,要(yao)(yao)結合(he)(he)地方(fang)(fang)機構設(she)置和監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)力量配(pei)置等(deng)情況確定監(jian)管(guan)(guan)(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)和職(zhi)責(ze)劃分(fen),確保事有人(ren)管(guan)(guan)(guan)(guan)(guan)(guan)、責(ze)有人(ren)負。對存在部(bu)(bu)門(men)(men)(men)管(guan)(guan)(guan)(guan)(guan)(guan)轄爭議的(de)(de)行(xing)政執法(fa)事項,各級(ji)司(si)法(fa)行(xing)政部(bu)(bu)門(men)(men)(men)要(yao)(yao)加(jia)強協調。
(六)完善跨部(bu)門綜(zong)合監管制度規則。各(ge)地區各(ge)部門(men)要強化(hua)監(jian)管(guan)(guan)政策(ce)的協同性、有效性和(he)可操作性,既要防止出(chu)現監(jian)管(guan)(guan)漏洞,又要避免(mian)政策(ce)疊加造成不(bu)利(li)影響。行業主(zhu)管(guan)(guan)部門(men)要會同相關監(jian)管(guan)(guan)部門(men)加快推進(jin)跨部門(men)綜(zong)(zong)合(he)(he)監(jian)管(guan)(guan)制度(du)建設,明確牽(qian)頭(tou)單(dan)位(wei)、配合(he)(he)單(dan)位(wei)、監(jian)管(guan)(guan)規(gui)則和(he)標(biao)(biao)準等,完善配套監(jian)管(guan)(guan)措施(shi);對(dui)現行監(jian)管(guan)(guan)標(biao)(biao)準不(bu)一(yi)致、相互不(bu)銜接的制度(du)規(gui)則,要抓緊修訂完善。支持各(ge)地區實施(shi)綜(zong)(zong)合(he)(he)監(jian)管(guan)(guan)“一(yi)業一(yi)冊(ce)”告知制度(du),一(yi)類事項制定一(yi)冊(ce)合(he)(he)規(gui)經營(ying)指南,一(yi)次性告知市場(chang)主(zhu)體合(he)(he)規(gui)經營(ying)要求,穩定市場(chang)主(zhu)體監(jian)管(guan)(guan)預(yu)期。
(七)健全(quan)跨部(bu)門(men)綜合監管工作機制。行業(ye)主(zhu)管(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)要會同相(xiang)關監(jian)(jian)管(guan)(guan)(guan)部(bu)(bu)門(men)(men)(men)根據監(jian)(jian)管(guan)(guan)(guan)需要,建(jian)(jian)(jian)立健(jian)(jian)全協(xie)同高(gao)效的(de)跨部(bu)(bu)門(men)(men)(men)綜合監(jian)(jian)管(guan)(guan)(guan)工(gong)作(zuo)機制,明確議事會商、情況通報(bao)等工(gong)作(zuo)要求(qiu),有(you)效整合監(jian)(jian)管(guan)(guan)(guan)資源,統(tong)籌(chou)(chou)監(jian)(jian)管(guan)(guan)(guan)政策制定,督促監(jian)(jian)管(guan)(guan)(guan)責(ze)任落實(shi),推(tui)動監(jian)(jian)管(guan)(guan)(guan)信息共(gong)享,組織(zhi)聯合執法(fa)檢查。已建(jian)(jian)(jian)立相(xiang)關工(gong)作(zuo)機制的(de),要進一步完善運行規則,加(jia)強業(ye)務(wu)統(tong)籌(chou)(chou),強化跨部(bu)(bu)門(men)(men)(men)綜合監(jian)(jian)管(guan)(guan)(guan)職能作(zuo)用。縣級以上(shang)地方人民政府(fu)要結合區域實(shi)際(ji),分事項(xiang)建(jian)(jian)(jian)立健(jian)(jian)全相(xiang)關跨部(bu)(bu)門(men)(men)(men)綜合監(jian)(jian)管(guan)(guan)(guan)工(gong)作(zuo)機制,加(jia)強統(tong)籌(chou)(chou)協(xie)調,推(tui)動解決突出(chu)問(wen)題(ti),防范化解重(zhong)大風險。
三、完善(shan)跨部門綜合監管協(xie)同方(fang)式(shi)
(八)加強風險隱患跨部門聯合監測。聚焦(jiao)問題(ti)多發(fa)和(he)高(gao)風險(xian)(xian)領域,構建科學(xue)高(gao)效(xiao)、多部(bu)門(men)(men)(men)聯(lian)動(dong)響(xiang)應的風險(xian)(xian)隱患監(jian)(jian)(jian)測(ce)預(yu)(yu)(yu)警(jing)機制,實現(xian)(xian)風險(xian)(xian)隱患動(dong)態監(jian)(jian)(jian)測(ce)、科學(xue)評估、精準(zhun)預(yu)(yu)(yu)警(jing)和(he)及(ji)時(shi)處(chu)置。要(yao)依托“互(hu)聯(lian)網+監(jian)(jian)(jian)管”等(deng)現(xian)(xian)有信息系統,針對(dui)(dui)具體監(jian)(jian)(jian)管事項的風險(xian)(xian)特點,構建跨(kua)部(bu)門(men)(men)(men)聯(lian)合監(jian)(jian)(jian)測(ce)預(yu)(yu)(yu)警(jing)模(mo)型,建立健全預(yu)(yu)(yu)警(jing)指標(biao)體系和(he)預(yu)(yu)(yu)警(jing)標(biao)準(zhun),明確預(yu)(yu)(yu)警(jing)信息推送規則,制定預(yu)(yu)(yu)警(jing)響(xiang)應和(he)處(chu)置預(yu)(yu)(yu)案。要(yao)利用信息技術手(shou)段全面提升監(jian)(jian)(jian)測(ce)感知能(neng)力,有效(xiao)歸集分析相(xiang)關部(bu)門(men)(men)(men)監(jian)(jian)(jian)管信息,及(ji)早發(fa)現(xian)(xian)和(he)處(chu)置各類風險(xian)(xian)隱患。對(dui)(dui)重大預(yu)(yu)(yu)警(jing)信息要(yao)開展跨(kua)部(bu)門(men)(men)(men)綜合研(yan)判、協同處(chu)置。
(九)開展市場(chang)主(zhu)體跨部門聯合抽(chou)查檢查。高效統籌監(jian)管(guan)(guan)(guan)執(zhi)法(fa)資(zi)源,大力(li)精簡(jian)整合(he)(he)(he)檢查(cha)(cha)事項,積極推行(xing)聯(lian)(lian)合(he)(he)(he)抽(chou)查(cha)(cha)檢查(cha)(cha),持續提升協同(tong)監(jian)管(guan)(guan)(guan)能力(li)。兩(liang)個以上部(bu)門(men)對(dui)同(tong)一監(jian)管(guan)(guan)(guan)對(dui)象實施不(bu)同(tong)行(xing)政檢查(cha)(cha)且(qie)可以同(tong)時開(kai)(kai)展(zhan)(zhan)的,原(yuan)則上應實行(xing)跨部(bu)門(men)聯(lian)(lian)合(he)(he)(he)檢查(cha)(cha)。開(kai)(kai)展(zhan)(zhan)跨部(bu)門(men)聯(lian)(lian)合(he)(he)(he)抽(chou)查(cha)(cha)檢查(cha)(cha)一般應采取“雙隨機(ji)、一公開(kai)(kai)”監(jian)管(guan)(guan)(guan)方式,要結合(he)(he)(he)監(jian)管(guan)(guan)(guan)對(dui)象信用等級和風(feng)險分類,不(bu)斷優化組織方式,合(he)(he)(he)理確(que)定抽(chou)查(cha)(cha)比(bi)例(li)、頻(pin)次和參與部(bu)門(men)等。發現涉及行(xing)業性(xing)(xing)、區域性(xing)(xing)違(wei)法(fa)違(wei)規行(xing)為或(huo)存(cun)在普遍性(xing)(xing)、多發性(xing)(xing)問題的,應及時組織開(kai)(kai)展(zhan)(zhan)跨部(bu)門(men)聯(lian)(lian)合(he)(he)(he)檢查(cha)(cha)或(huo)專項整治。
(十(shi))推進問題線索跨部(bu)門聯(lian)合處(chu)置。不斷拓寬(kuan)問(wen)(wen)(wen)題(ti)線索(suo)(suo)收(shou)集(ji)渠道,通過12345政務服務便民熱線、全國一體化在(zai)(zai)線監(jian)管平臺以及(ji)行業協會、新聞(wen)媒體等(deng)(deng)多(duo)種(zhong)渠道廣泛(fan)收(shou)集(ji)問(wen)(wen)(wen)題(ti)線索(suo)(suo),加(jia)強大(da)數據分析,形(xing)成社(she)會多(duo)元(yuan)共治合力。建立(li)健(jian)全問(wen)(wen)(wen)題(ti)線索(suo)(suo)分辦、轉(zhuan)辦和查(cha)處工作(zuo)機制,對涉及(ji)多(duo)部(bu)(bu)(bu)門(men)監(jian)管職責的問(wen)(wen)(wen)題(ti)線索(suo)(suo),及(ji)時(shi)(shi)轉(zhuan)送相(xiang)(xiang)關部(bu)(bu)(bu)門(men)協同開展(zhan)核(he)查(cha),依法依規進(jin)行處理(li),既要(yao)做到應(ying)查(cha)必查(cha)、有效處置,又要(yao)防止多(duo)頭檢查(cha)、重復處罰。各部(bu)(bu)(bu)門(men)在(zai)(zai)工作(zuo)中發現屬(shu)于其他(ta)部(bu)(bu)(bu)門(men)監(jian)管職責的違(wei)(wei)法違(wei)(wei)規行為(wei),要(yao)及(ji)時(shi)(shi)將(jiang)線索(suo)(suo)等(deng)(deng)推送給相(xiang)(xiang)關部(bu)(bu)(bu)門(men),相(xiang)(xiang)關部(bu)(bu)(bu)門(men)要(yao)及(ji)時(shi)(shi)進(jin)行調查(cha)處理(li)。
(十(shi)一)積極開展跨(kua)部門聯合信用(yong)監管。根(gen)據跨部(bu)門(men)(men)(men)綜合監(jian)管(guan)(guan)(guan)對(dui)象的(de)屬性(xing)和風險特點(dian),積極(ji)探索(suo)符合行業監(jian)管(guan)(guan)(guan)需要(yao)的(de)信用(yong)監(jian)管(guan)(guan)(guan)模式,充分發(fa)揮(hui)信用(yong)監(jian)管(guan)(guan)(guan)在(zai)配置監(jian)管(guan)(guan)(guan)資源、防范(fan)化解風險等方面(mian)的(de)重要(yao)作用(yong)。行業主管(guan)(guan)(guan)部(bu)門(men)(men)(men)要(yao)會(hui)同(tong)相(xiang)(xiang)關監(jian)管(guan)(guan)(guan)部(bu)門(men)(men)(men)建立(li)健全(quan)(quan)跨部(bu)門(men)(men)(men)綜合監(jian)管(guan)(guan)(guan)事項信用(yong)評價指標(biao)體系,明確(que)分級分類標(biao)準及相(xiang)(xiang)應的(de)協同(tong)監(jian)管(guan)(guan)(guan)措施。相(xiang)(xiang)關部(bu)門(men)(men)(men)在(zai)注冊登(deng)記、資質審核(he)、日常監(jian)管(guan)(guan)(guan)、公共(gong)服(fu)務、執法(fa)辦案過程中,要(yao)準確(que)、全(quan)(quan)面(mian)記錄市場(chang)主體信用(yong)行為(wei),及時歸集共(gong)享信用(yong)信息。發(fa)現存在(zai)違法(fa)失(shi)信行為(wei)的(de),要(yao)及時通報(bao)相(xiang)(xiang)關部(bu)門(men)(men)(men),依(yi)法(fa)開展失(shi)信懲戒(jie)。
四、提升跨部(bu)門綜合監管聯動效能
(十二)加強部(bu)門與地方監管聯(lian)動。各部(bu)(bu)門制定監(jian)管(guan)(guan)(guan)政(zheng)策要(yao)(yao)(yao)充分聽取地(di)(di)(di)方(fang)(fang)的(de)意見建議;加強對(dui)地(di)(di)(di)方(fang)(fang)的(de)業(ye)務(wu)指導(dao),全面研判(pan)風險隱患,督促相關(guan)地(di)(di)(di)區(qu)(qu)彌補監(jian)管(guan)(guan)(guan)短(duan)板;建立(li)監(jian)管(guan)(guan)(guan)資源(yuan)統籌調配機制,對(dui)需要(yao)(yao)(yao)調用(yong)異地(di)(di)(di)監(jian)管(guan)(guan)(guan)執(zhi)法資源(yuan)處置(zhi)違(wei)法違(wei)規問(wen)題以(yi)及(ji)有關(guan)地(di)(di)(di)區(qu)(qu)提出(chu)監(jian)管(guan)(guan)(guan)協助需要(yao)(yao)(yao)的(de),及(ji)時(shi)協調開(kai)展(zhan)跨(kua)(kua)區(qu)(qu)域(yu)監(jian)管(guan)(guan)(guan)執(zhi)法。垂直(zhi)管(guan)(guan)(guan)理部(bu)(bu)門要(yao)(yao)(yao)加強與地(di)(di)(di)方(fang)(fang)政(zheng)府之間(jian)的(de)信(xin)息共享和執(zhi)法協作。各地(di)(di)(di)區(qu)(qu)要(yao)(yao)(yao)加強與相關(guan)部(bu)(bu)門的(de)溝通聯系,及(ji)時(shi)分析(xi)本地(di)(di)(di)區(qu)(qu)監(jian)管(guan)(guan)(guan)突(tu)出(chu)問(wen)題,對(dui)本地(di)(di)(di)區(qu)(qu)跨(kua)(kua)部(bu)(bu)門綜合監(jian)管(guan)(guan)(guan)事項實施有效(xiao)監(jian)管(guan)(guan)(guan);有效(xiao)整合監(jian)管(guan)(guan)(guan)資源(yuan),及(ji)時(shi)共享監(jian)管(guan)(guan)(guan)信(xin)息,支持和配合有關(guan)部(bu)(bu)門開(kai)展(zhan)跨(kua)(kua)區(qu)(qu)域(yu)、跨(kua)(kua)層級監(jian)管(guan)(guan)(guan)工(gong)作。
(十三)加強跨(kua)區域監(jian)管聯(lian)動。針對跨(kua)(kua)部門綜合(he)監管(guan)涉及(ji)的跨(kua)(kua)區(qu)(qu)域(yu)監管(guan)缺位、管(guan)轄爭議、執(zhi)法(fa)辦案困難(nan)等(deng)問題,建(jian)立健全源頭追溯、信息(xi)共享、線索移送(song)、聯(lian)合(he)調(diao)查(cha)、執(zhi)法(fa)聯(lian)動(dong)、執(zhi)法(fa)互(hu)認等(deng)機(ji)制。加快(kuai)推(tui)進食(shi)品(pin)安全、道路運(yun)輸安全、知識(shi)產權保護、資質資格認定(ding)(ding)、商業(ye)特許經營等(deng)跨(kua)(kua)區(qu)(qu)域(yu)監管(guan)協(xie)作,切實加強(qiang)大氣污染(ran)、水(shui)污染(ran)、固體廢物轉(zhuan)移等(deng)跨(kua)(kua)區(qu)(qu)域(yu)聯(lian)防聯(lian)治。鼓勵跨(kua)(kua)行政區(qu)(qu)域(yu)按規(gui)定(ding)(ding)聯(lian)合(he)發布統一監管(guan)政策法(fa)規(gui)及(ji)區(qu)(qu)域(yu)性地方標準,加強(qiang)調(diao)查(cha)取證和案件(jian)處置合(he)作,京津(jin)冀(ji)、長(chang)三角、粵港澳大灣區(qu)(qu)、成渝等(deng)地區(qu)(qu)要積(ji)極探索創新聯(lian)合(he)監管(guan)模式。
(十四)加強(qiang)行政執法與刑事司法聯動。行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)(fa)機(ji)關(guan)(guan)要與(yu)司法(fa)(fa)(fa)(fa)機(ji)關(guan)(guan)加強信(xin)息共享、線索移送(song)(song)、聯合(he)調(diao)查等方面協調(diao)配合(he),建立(li)健全行(xing)(xing)刑(xing)銜接機(ji)制。根據不同領(ling)域監(jian)管實際需要,完善案(an)(an)件移送(song)(song)、雙向咨詢、情況通報、信(xin)息共享、檢(jian)驗鑒定結果(guo)互認等機(ji)制。行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)(fa)機(ji)關(guan)(guan)在(zai)依(yi)(yi)法(fa)(fa)(fa)(fa)查處違法(fa)(fa)(fa)(fa)行(xing)(xing)為過程中發現涉嫌犯罪、依(yi)(yi)法(fa)(fa)(fa)(fa)需要追究刑(xing)事(shi)責任的,應及時移送(song)(song)有關(guan)(guan)機(ji)關(guan)(guan)處理(li);存(cun)在(zai)暴力抗法(fa)(fa)(fa)(fa)等情形的,可商請有關(guan)(guan)機(ji)關(guan)(guan)協助(zhu)調(diao)查處理(li)。有關(guan)(guan)機(ji)關(guan)(guan)立(li)案(an)(an)后提請行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)(fa)機(ji)關(guan)(guan)作出檢(jian)驗、鑒定、認定和涉案(an)(an)物(wu)品(pin)保存(cun)、銷毀(hui)、處置等協助(zhu)的,行(xing)(xing)政(zheng)(zheng)執(zhi)法(fa)(fa)(fa)(fa)機(ji)關(guan)(guan)要積(ji)極(ji)配合(he)。
