湖南省強化危險(xian)廢(fei)物(wu)監(jian)管和利用處置能(neng)力改革實(shi)施方案

為切(qie)實提(ti)升危(wei)(wei)(wei)險(xian)廢(fei)物(wu)監管和利用處置能力(li),有(you)效(xiao)防范危(wei)(wei)(wei)險(xian)廢(fei)物(wu)環境與安全(quan)風(feng)險(xian),根據《中華人(ren)民(min)共(gong)和國固體廢(fei)物(wu)污染環境防治法(fa)》《國務院辦公廳(ting)關于印發強(qiang)化(hua)危(wei)(wei)(wei)險(xian)廢(fei)物(wu)監管和利用處置能力(li)改(gai)革實施方(fang)案的通知》等法(fa)律(lv)法(fa)規和政策文件(jian),結合我省實際,特(te)制定本方(fang)案。

一、總體(ti)要求

(一)指(zhi)導思想。以(yi)習(xi)(xi)近平新時代中國特色社會主義思想為(wei)(wei)指導,全(quan)面貫徹黨的(de)二十(shi)大精神,深(shen)(shen)入貫徹落實習(xi)(xi)近平生(sheng)態文(wen)明(ming)思想和習(xi)(xi)近平總書(shu)記(ji)對湖南重要講(jiang)話重要指示批示精神,緊緊圍繞(rao)省(sheng)委、省(sheng)政府“三(san)高四新”戰略定位和使命任(ren)務,深(shen)(shen)入打好污染防治攻(gong)堅戰,以(yi)防范(fan)環(huan)境與安(an)全(quan)風險為(wei)(wei)目標,以(yi)持續改(gai)善生(sheng)態環(huan)境質量為(wei)(wei)核心,優化頂(ding)層設計、深(shen)(shen)化監(jian)(jian)管體制機制改(gai)革,堅持精準(zhun)治污、科學治污、依法治污,持續提(ti)升危險廢物環(huan)境監(jian)(jian)管能力、利(li)用處置能力和風險防范(fan)能力,維護人民群眾身體健康和生(sheng)態環(huan)境安(an)全(quan)。

(二(er))工作原(yuan)則。

堅持改革創新,先(xian)行(xing)示范(fan)。全面深化監管體制(zhi)機制(zhi)改革,創新方式方法,激發市場活力,推動危險廢(fei)物污染(ran)環境防治先(xian)行(xing)示范(fan)。

堅持(chi)科(ke)學統(tong)(tong)籌,補齊短(duan)板。統(tong)(tong)籌就近處理(li),通(tong)過科(ke)學評(ping)估、合理(li)布局(ju)、優化(hua)結構,推動(dong)危(wei)險廢(fei)物(wu)源頭減量化(hua)、過程資源化(hua)、處置無害化(hua),補齊醫療廢(fei)物(wu)、危(wei)險廢(fei)物(wu)收(shou)集處理(li)設施(shi)方面(mian)短(duan)板。

堅持多元(yuan)共(gong)管,保障民生。完善(shan)危險(xian)(xian)廢(fei)物監(jian)管跨(kua)部門聯動機制(zhi),強化(hua)政府(fu)引導與支持,壓(ya)實企業、園區、部門責任,充(chong)分發揮社會組織和公眾(zhong)監(jian)督作用,推動解決影響群眾(zhong)身邊的涉危險(xian)(xian)廢(fei)物污染(ran)問題,有效維護群眾(zhong)切(qie)身利(li)益。

(三)總體目標。進一步完(wan)善危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)環境(jing)監管(guan)(guan)體制機(ji)(ji)制,建立安全監管(guan)(guan)與環境(jing)監管(guan)(guan)聯動機(ji)(ji)制,有效遏制危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)環境(jing)違法行為(wei)。基(ji)本補齊醫療廢(fei)(fei)(fei)(fei)物(wu)、危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)收集(ji)處(chu)(chu)理設(she)施短板,縣(xian)級以上城市建成區醫療廢(fei)(fei)(fei)(fei)物(wu)無害化處(chu)(chu)置率(lv)達99%以上,全省(sheng)危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)利(li)用處(chu)(chu)置能(neng)力基(ji)本滿足本行政區域內的處(chu)(chu)理需求。到(dao)2025年(nian)底,建立“源頭嚴防(fang)、過(guo)程嚴管(guan)(guan)、后(hou)果嚴懲”危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)監管(guan)(guan)體系;危(wei)(wei)險(xian)廢(fei)(fei)(fei)(fei)物(wu)利(li)用處(chu)(chu)置能(neng)力充(chong)分(fen)保障,技術和(he)運營(ying)水平持續提升。

二、落實危險廢(fei)物(wu)管理職責

(四)壓實政(zheng)府(fu)和部門(men)責(ze)任。嚴格(ge)(ge)落實“黨政同責(ze)(ze)(ze)、一崗雙責(ze)(ze)(ze)”,將(jiang)危(wei)險廢物污染環(huan)境(jing)(jing)(jing)(jing)防(fang)治工(gong)(gong)作(zuo)納入國民(min)經濟和(he)(he)(he)社(she)會發(fa)展規劃、生(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)(jing)保(bao)護規劃。各(ge)市(shi)(shi)州(zhou)、縣市(shi)(shi)區人(ren)民(min)政府將(jiang)危(wei)險廢物污染環(huan)境(jing)(jing)(jing)(jing)防(fang)治情況納入環(huan)境(jing)(jing)(jing)(jing)狀況和(he)(he)(he)環(huan)境(jing)(jing)(jing)(jing)保(bao)護目(mu)標完成(cheng)情況年度報告,并(bing)向本級人(ren)民(min)代(dai)表(biao)大會或者人(ren)民(min)代(dai)表(biao)大會常務委(wei)員會報告。對做出顯著成(cheng)績的依(yi)法給予(yu)表(biao)彰,對不履行(xing)危(wei)險廢物監(jian)(jian)管責(ze)(ze)(ze)任(ren)(ren)的依(yi)法追責(ze)(ze)(ze)。(省(sheng)生(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)(jing)廳(ting)(ting)牽(qian)(qian)頭(tou),省(sheng)直相關單位按(an)職責(ze)(ze)(ze)分工(gong)(gong)負(fu)責(ze)(ze)(ze),各(ge)市(shi)(shi)州(zhou)、縣市(shi)(shi)區人(ren)民(min)政府負(fu)責(ze)(ze)(ze)落實,以下均需(xu)各(ge)市(shi)(shi)州(zhou)、縣市(shi)(shi)區政府負(fu)責(ze)(ze)(ze)落實,不再列出)建(jian)立和(he)(he)(he)完善危(wei)險廢物污染環(huan)境(jing)(jing)(jing)(jing)防(fang)治目(mu)標責(ze)(ze)(ze)任(ren)(ren)制和(he)(he)(he)考核(he)評(ping)價制度,將(jiang)目(mu)標完成(cheng)情況作(zuo)為考核(he)評(ping)價黨政領(ling)(ling)導班子和(he)(he)(he)有關領(ling)(ling)導干部的重要參考。(省(sheng)生(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)(jing)廳(ting)(ting)牽(qian)(qian)頭(tou),省(sheng)委(wei)組織部等參與(yu))發(fa)展改革、工(gong)(gong)業(ye)(ye)和(he)(he)(he)信息化、生(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)(jing)、自然(ran)資源、住房城(cheng)鄉(xiang)(xiang)建(jian)設、交通運輸(shu)、應(ying)急管理(li)、農(nong)業(ye)(ye)農(nong)村、衛(wei)生(sheng)(sheng)健康、公(gong)安、海關等有關部門,按(an)照職責(ze)(ze)(ze)分工(gong)(gong)嚴格(ge)(ge)履行(xing)其在危(wei)險廢物利用處置、污染防(fang)治、安全生(sheng)(sheng)產、運輸(shu)安全及(ji)衛(wei)生(sheng)(sheng)防(fang)疫等方面的監(jian)(jian)管職責(ze)(ze)(ze),強化工(gong)(gong)作(zuo)協同聯動,對不履行(xing)危(wei)險廢物監(jian)(jian)管責(ze)(ze)(ze)任(ren)(ren)或監(jian)(jian)管不到(dao)位的,依(yi)法嚴肅追究(jiu)責(ze)(ze)(ze)任(ren)(ren)。(省(sheng)發(fa)展改革委(wei)、省(sheng)工(gong)(gong)業(ye)(ye)和(he)(he)(he)信息化廳(ting)(ting)、省(sheng)生(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)(jing)廳(ting)(ting)、省(sheng)自然(ran)資源廳(ting)(ting)、省(sheng)住房城(cheng)鄉(xiang)(xiang)建(jian)設廳(ting)(ting)、省(sheng)交通運輸(shu)廳(ting)(ting)、省(sheng)應(ying)急廳(ting)(ting)、省(sheng)農(nong)業(ye)(ye)農(nong)村廳(ting)(ting)、省(sheng)衛(wei)生(sheng)(sheng)健康委(wei)、省(sheng)公(gong)安廳(ting)(ting)等按(an)職責(ze)(ze)(ze)分工(gong)(gong)負(fu)責(ze)(ze)(ze))

(五)強(qiang)化園區管理責任。進(jin)一步(bu)強化工(gong)業園區(qu)管(guan)理(li)(li)職(zhi)責,將危(wei)險(xian)(xian)廢(fei)物(wu)(wu)污染環(huan)境(jing)(jing)防治工(gong)作納(na)入年度(du)評(ping)價重要(yao)內(nei)容。園區(qu)管(guan)理(li)(li)機構應(ying)分(fen)級分(fen)類動態(tai)建立危(wei)險(xian)(xian)廢(fei)物(wu)(wu)重點監管(guan)清單;探索環(huan)保(bao)管(guan)家駐點協助管(guan)理(li)(li)模式,定期深(shen)入排(pai)查環(huan)境(jing)(jing)隱患、科學評(ping)估園區(qu)內(nei)企業危(wei)險(xian)(xian)廢(fei)物(wu)(wu)產生種類與數量及(ji)園區(qu)集(ji)中收集(ji)貯存(cun)處理(li)(li)設施存(cun)在的環(huan)境(jing)(jing)風(feng)險(xian)(xian),打通危(wei)險(xian)(xian)廢(fei)物(wu)(wu)資源利用園區(qu)小循環(huan),保(bao)障園區(qu)危(wei)險(xian)(xian)廢(fei)物(wu)(wu)利用處置能力。(省生態(tai)環(huan)境(jing)(jing)廳、省發(fa)展改革委等按(an)職(zhi)責分(fen)工(gong)負責,各工(gong)業園區(qu)負責落實)

(六)落實企(qi)業主體責任。危(wei)險(xian)廢物產(chan)生(sheng)(sheng)、收集、貯存、運輸(shu)、利用(yong)、處(chu)置單(dan)位(wei)(以下統稱“危(wei)險(xian)廢物相(xiang)關單(dan)位(wei)”)是(shi)危(wei)險(xian)廢物污(wu)(wu)染(ran)環境(jing)(jing)防(fang)治和安全生(sheng)(sheng)產(chan)法(fa)定責(ze)任主(zhu)體,其(qi)主(zhu)要負責(ze)人(法(fa)定代(dai)表人、實際控制人)是(shi)第(di)一責(ze)任人,嚴(yan)格(ge)執行相(xiang)關法(fa)律(lv)法(fa)規(gui)(gui)與規(gui)(gui)章制度。(省(sheng)(sheng)生(sheng)(sheng)態環境(jing)(jing)廳(ting)、省(sheng)(sheng)衛生(sheng)(sheng)健康(kang)委、省(sheng)(sheng)公(gong)安廳(ting)、省(sheng)(sheng)交通(tong)運輸(shu)廳(ting)、省(sheng)(sheng)應急廳(ting)等按職責(ze)分工(gong)負責(ze))危(wei)險(xian)廢物相(xiang)關企業依法(fa)及時公(gong)開危(wei)險(xian)廢物污(wu)(wu)染(ran)環境(jing)(jing)防(fang)治信息,依法(fa)依規(gui)(gui)投保(bao)環境(jing)(jing)污(wu)(wu)染(ran)責(ze)任保(bao)險(xian)。(省(sheng)(sheng)生(sheng)(sheng)態環境(jing)(jing)廳(ting)、湖南銀保(bao)監局等按職責(ze)分工(gong)負責(ze))

三、突(tu)出危險廢(fei)物(wu)源頭管控

(七)嚴格(ge)環境準入。嚴(yan)格落實“三線一單”管控(kong)、危(wei)險廢(fei)物(wu)污染環境防治(zhi)設(she)(she)施(shi)“三同時”管理(li)和工(gong)業危(wei)險廢(fei)物(wu)排污許可(ke)制(zhi)度等要求,依(yi)法依(yi)規(gui)對(dui)已批(pi)復的(de)(de)重(zhong)點行業涉危(wei)險廢(fei)物(wu)建設(she)(she)項目(mu)環境影響評價文件開(kai)(kai)展復核,對(dui)年產危(wei)廢(fei)量大于500噸的(de)(de)重(zhong)點行業(有色金(jin)屬冶煉、有色金(jin)屬礦采選(xuan)、化(hua)工(gong)、電(dian)解(jie)錳、電(dian)鍍、制(zhi)革(ge)、石油加工(gong)等)建設(she)(she)項目(mu)的(de)(de)排污許可(ke)、環保(bao)竣工(gong)驗收(shou)等文件開(kai)(kai)展抽查核查。(省生態環境廳負責)

(八)推進源(yuan)頭減量。支持研發、推(tui)廣減少危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)產(chan)生(sheng)(sheng)量和降低危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)危(wei)害(hai)性的生(sheng)(sheng)產(chan)工(gong)(gong)(gong)藝及設(she)(she)備,從源頭上減少危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)產(chan)生(sheng)(sheng)量、降低危(wei)害(hai)性;不斷提升(sheng)危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)經營(ying)單位清潔生(sheng)(sheng)產(chan)水平;鼓勵產(chan)生(sheng)(sheng)危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)以及涉危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)工(gong)(gong)(gong)業園(yuan)區依法(fa)自行處置危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu),年產(chan)危(wei)廢(fei)(fei)(fei)量大(da)于2萬噸的工(gong)(gong)(gong)業園(yuan)區、年產(chan)危(wei)廢(fei)(fei)(fei)量大(da)于5千噸的新建、擴建工(gong)(gong)(gong)業企業應配套建設(she)(she)危(wei)險(xian)(xian)廢(fei)(fei)(fei)物(wu)(wu)自行處理設(she)(she)施;打造一批(pi)有色冶煉、鋼鐵、化工(gong)(gong)(gong)等(deng)行業綠色示范企業。(省(sheng)(sheng)(sheng)工(gong)(gong)(gong)業和信息化廳(ting)、省(sheng)(sheng)(sheng)發展改革(ge)委、省(sheng)(sheng)(sheng)科(ke)技廳(ting)、省(sheng)(sheng)(sheng)生(sheng)(sheng)態環境(jing)廳(ting)等(deng)按職責分工(gong)(gong)(gong)負責)

(九)推動鑒(jian)別鑒(jian)定。強化危(wei)險(xian)廢(fei)物(wu)(wu)產生(sheng)企業鑒別(bie)主體責任(ren),督促企業及時對定性不明的副產物(wu)(wu)等物(wu)(wu)料進行主動(dong)鑒別(bie),嚴格執行《國家危(wei)險(xian)廢(fei)物(wu)(wu)名錄》和危(wei)險(xian)廢(fei)物(wu)(wu)鑒別(bie)相關規(gui)定,對環(huan)境風險(xian)小(xiao)的危(wei)險(xian)廢(fei)物(wu)(wu)實行特定環(huan)節豁免(mian)管理,開展(zhan)危(wei)險(xian)廢(fei)物(wu)(wu)鑒別(bie)試點。(省生(sheng)態環(huan)境廳(ting)牽(qian)頭,省市(shi)場(chang)監管局等按職責分(fen)工負責)

(十)嚴格轉移管理。嚴格執行《湖南省危險廢物跨省轉入利用管理辦法(試行)》,嚴禁將已納入跨省轉入“黑名單”管理類別的危險廢物轉入省內利用,簡化納入“白名單”管理類別的危險廢物轉入審批程序。(省生態環境廳牽頭,省公安廳、省交通運輸廳等參與)

四、加強危險(xian)廢(fei)物收(shou)集貯存轉(zhuan)運體系(xi)建(jian)設

(十一)規范危險廢物貯存設施。新建(jian)項目應結合危廢產生量、貯(zhu)存(cun)周期等,配套建(jian)設(she)符合規范要求的貯(zhu)存(cun)場所,嚴格按照《危險廢物貯(zhu)存(cun)污染控制標準》建(jian)設(she),嚴格執行分類分區貯(zhu)存(cun)要求。(省生態環境廳負責)
