江西省強化危險廢物監管和利(li)用(yong)處(chu)置能力改(gai)革(ge)實施方案
為全面落(luo)實(shi)(shi)《國(guo)務院(yuan)辦公廳關于印發(fa)強化(hua)危(wei)險廢物監管和利用(yong)處(chu)置能力改革(ge)實(shi)(shi)施方案的通知》(國(guo)辦函〔2021〕47號(hao))精(jing)神,提升全省危(wei)險廢物監管、利用(yong)處(chu)置和風險防范(fan)能力,結合我省實(shi)(shi)際(ji),制定本方案。
一、總(zong)體要求
堅持(chi)以習(xi)近平生態文明(ming)思(si)想為(wei)指(zhi)引,深(shen)入貫(guan)徹(che)黨(dang)的十九大(da)和(he)十九屆歷次(ci)全(quan)(quan)(quan)(quan)會精神,全(quan)(quan)(quan)(quan)面落實(shi)黨(dang)中央、國務院決策部署,按照省(sheng)十五次(ci)黨(dang)代會和(he)省(sheng)委、省(sheng)政府工作要求,堅持(chi)精準治(zhi)(zhi)污、科學(xue)治(zhi)(zhi)污、依法治(zhi)(zhi)污,以源頭(tou)防控(kong)為(wei)抓手(shou)、持(chi)續改善生態環境(jing)(jing)質(zhi)量為(wei)核(he)心、有效防控(kong)危險(xian)廢物環境(jing)(jing)與安全(quan)(quan)(quan)(quan)風險(xian)為(wei)目標,深(shen)化體(ti)制(zhi)機制(zhi)改革,著力提升危險(xian)廢物監管和(he)利用處置能力,切(qie)實(shi)維護人民群眾身體(ti)健康和(he)生態環境(jing)(jing)安全(quan)(quan)(quan)(quan)。
到(dao)2022年底,全省危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)監(jian)(jian)(jian)管(guan)(guan)(guan)體制(zhi)機制(zhi)進(jin)一步完善,建立健全安全監(jian)(jian)(jian)管(guan)(guan)(guan)與環境監(jian)(jian)(jian)管(guan)(guan)(guan)聯動(dong)機制(zhi);危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)非法轉移傾倒行為得(de)到(dao)有效遏制(zhi);基本(ben)補(bu)齊全省醫(yi)療廢(fei)物(wu)(wu)、危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)收集處(chu)(chu)理(li)能力短板,縣級以上城市建成(cheng)區醫(yi)療廢(fei)物(wu)(wu)無害(hai)化處(chu)(chu)置率達到(dao)100%,危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)利用處(chu)(chu)置能力基本(ben)滿(man)足省內需(xu)求。到(dao)2025年底,全省建立健全源頭嚴防、過程(cheng)嚴管(guan)(guan)(guan)、后果嚴懲(cheng)的危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)監(jian)(jian)(jian)管(guan)(guan)(guan)體系(xi);危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)利用處(chu)(chu)置能力充分(fen)保障,技術(shu)和運營水平進(jin)一步提升,實(shi)現危(wei)險(xian)(xian)(xian)廢(fei)物(wu)(wu)產生、收集、貯(zhu)存(cun)、運輸、利用處(chu)(chu)置全鏈條閉環監(jian)(jian)(jian)管(guan)(guan)(guan),為更高(gao)標準(zhun)打造美麗中(zhong)國“江西(xi)樣(yang)板”貢獻力量。
二、健全危險廢物監管體制(zhi)機制(zhi)
(一)依法履行危(wei)險(xian)廢(fei)(fei)物(wu)(wu)監(jian)管職(zhi)責(ze)。各(ge)市、縣(xian)(區(qu))人民(min)政府對本(ben)轄區(qu)內危(wei)險(xian)廢(fei)(fei)物(wu)(wu)治理負總責(ze)。發(fa)展(zhan)(zhan)改革(ge)、工業和(he)信(xin)息化、生(sheng)(sheng)(sheng)(sheng)態環(huan)(huan)(huan)境、應急管理、農(nong)業農(nong)村(cun)、公安(an)、交通運(yun)輸、衛生(sheng)(sheng)(sheng)(sheng)健康(kang)、住(zhu)房城(cheng)(cheng)鄉建設、海關等(deng)有(you)關部(bu)(bu)門要落(luo)實(shi)在危(wei)險(xian)廢(fei)(fei)物(wu)(wu)利用處置、污染環(huan)(huan)(huan)境防(fang)(fang)(fang)治、安(an)全生(sheng)(sheng)(sheng)(sheng)產、運(yun)輸安(an)全以及(ji)衛生(sheng)(sheng)(sheng)(sheng)防(fang)(fang)(fang)疫等(deng)方面的(de)(de)監(jian)管職(zhi)責(ze)。強化部(bu)(bu)門間溝通協作(zuo)(zuo),形成工作(zuo)(zuo)合(he)力,支持有(you)條件的(de)(de)地市開展(zhan)(zhan)“無廢(fei)(fei)城(cheng)(cheng)市”建設。鼓勵行業協會(hui)加強行業引導(dao)(dao),促進行業自律。(省生(sheng)(sheng)(sheng)(sheng)態環(huan)(huan)(huan)境廳(ting)(ting)、省發(fa)展(zhan)(zhan)改革(ge)委(wei)、省工業和(he)信(xin)息化廳(ting)(ting)、省公安(an)廳(ting)(ting)、省住(zhu)房城(cheng)(cheng)鄉建設廳(ting)(ting)、省交通運(yun)輸廳(ting)(ting)、省衛生(sheng)(sheng)(sheng)(sheng)健康(kang)委(wei)、省應急廳(ting)(ting)、省農(nong)業農(nong)村(cun)廳(ting)(ting)、南昌海關,各(ge)市、縣(xian)〔區(qu)〕人民(min)政府按(an)職(zhi)責(ze)分工負責(ze)。以下均需各(ge)市、縣(xian)〔區(qu)〕人民(min)政府落(luo)實(shi),不再(zai)列出)建立危(wei)險(xian)廢(fei)(fei)物(wu)(wu)污染環(huan)(huan)(huan)境防(fang)(fang)(fang)治目標責(ze)任制和(he)考核評(ping)價制度(du),將危(wei)險(xian)廢(fei)(fei)物(wu)(wu)污染環(huan)(huan)(huan)境防(fang)(fang)(fang)治目標完成情(qing)況作(zuo)(zuo)為考核評(ping)價黨政領導(dao)(dao)班子和(he)有(you)關領導(dao)(dao)干部(bu)(bu)的(de)(de)重(zhong)要參(can)考。(省生(sheng)(sheng)(sheng)(sheng)態環(huan)(huan)(huan)境廳(ting)(ting)牽(qian)頭,省委(wei)組(zu)織部(bu)(bu)等(deng)參(can)與)
(二(er))建立(li)區(qu)域(yu)(yu)聯(lian)(lian)防聯(lian)(lian)控機(ji)制(zhi)。深入推進(jin)與周邊省(sheng)(sheng)份的危(wei)險廢物(wu)(wu)環(huan)(huan)境風險區(qu)域(yu)(yu)聯(lian)(lian)防聯(lian)(lian)控機(ji)制(zhi),加強危(wei)險廢物(wu)(wu)管理信息共享(xiang)與協調合作,提升(sheng)聯(lian)(lian)防聯(lian)(lian)控合力;推動省(sheng)(sheng)內跨區(qu)域(yu)(yu)、多層級聯(lian)(lian)動執(zhi)法(fa),統籌省(sheng)(sheng)市縣三(san)級執(zhi)法(fa)力量(liang),針對行(xing)(xing)政區(qu)域(yu)(yu)交界處(chu)、重點流域(yu)(yu)上游(you)、鄉村及(ji)偏遠地區(qu)開展聯(lian)(lian)合執(zhi)法(fa),依(yi)法(fa)嚴(yan)厲(li)打擊跨區(qu)域(yu)(yu)涉危(wei)險廢物(wu)(wu)非法(fa)收集、貯存、轉移(yi)和利(li)用處(chu)置環(huan)(huan)境違法(fa)行(xing)(xing)為。(省(sheng)(sheng)生態環(huan)(huan)境廳(ting)牽頭,省(sheng)(sheng)公安廳(ting)、省(sheng)(sheng)交通運輸廳(ting)等參與)
(三)壓實(shi)企(qi)(qi)事業單(dan)位(wei)(wei)(wei)主(zhu)體責(ze)(ze)任。危險(xian)廢(fei)(fei)物(wu)(wu)(wu)產(chan)生(sheng)(sheng)、收集(ji)、貯(zhu)存、運(yun)輸、利用、處置企(qi)(qi)事業單(dan)位(wei)(wei)(wei)(以下(xia)統(tong)稱(cheng)危險(xian)廢(fei)(fei)物(wu)(wu)(wu)相(xiang)關(guan)單(dan)位(wei)(wei)(wei))的主(zhu)要負(fu)責(ze)(ze)人(ren)(法(fa)(fa)定代表人(ren)、實(shi)際控制人(ren))是危險(xian)廢(fei)(fei)物(wu)(wu)(wu)污(wu)染(ran)環(huan)境(jing)防治(zhi)(zhi)和安(an)(an)全生(sheng)(sheng)產(chan)第一(yi)責(ze)(ze)任人(ren),須嚴格落實(shi)危險(xian)廢(fei)(fei)物(wu)(wu)(wu)污(wu)染(ran)環(huan)境(jing)防治(zhi)(zhi)和安(an)(an)全生(sheng)(sheng)產(chan)法(fa)(fa)律法(fa)(fa)規制度,確保環(huan)境(jing)安(an)(an)全、生(sheng)(sheng)產(chan)安(an)(an)全、運(yun)輸安(an)(an)全和衛生(sheng)(sheng)防疫安(an)(an)全。(省(sheng)(sheng)(sheng)(sheng)生(sheng)(sheng)態環(huan)境(jing)廳(ting)(ting)、省(sheng)(sheng)(sheng)(sheng)公安(an)(an)廳(ting)(ting)、省(sheng)(sheng)(sheng)(sheng)交通運(yun)輸廳(ting)(ting)、省(sheng)(sheng)(sheng)(sheng)衛生(sheng)(sheng)健(jian)康委、省(sheng)(sheng)(sheng)(sheng)應急(ji)廳(ting)(ting)等(deng)按職(zhi)責(ze)(ze)分(fen)工(gong)(gong)負(fu)責(ze)(ze))危險(xian)廢(fei)(fei)物(wu)(wu)(wu)相(xiang)關(guan)單(dan)位(wei)(wei)(wei)應依(yi)法(fa)(fa)及時(shi)公開危險(xian)廢(fei)(fei)物(wu)(wu)(wu)污(wu)染(ran)環(huan)境(jing)防治(zhi)(zhi)信息,依(yi)法(fa)(fa)依(yi)規投保環(huan)境(jing)污(wu)染(ran)責(ze)(ze)任保險(xian)。(省(sheng)(sheng)(sheng)(sheng)生(sheng)(sheng)態環(huan)境(jing)廳(ting)(ting)、江西(xi)銀保監局等(deng)按職(zhi)責(ze)(ze)分(fen)工(gong)(gong)負(fu)責(ze)(ze))
(四)完(wan)善危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)環境管理(li)(li)信(xin)息化(hua)(hua)體(ti)(ti)系(xi)(xi)。健全優化(hua)(hua)江西省(sheng)固體(ti)(ti)廢(fei)(fei)物(wu)智(zhi)(zhi)(zhi)能(neng)監管一(yi)體(ti)(ti)化(hua)(hua)服(fu)務平臺(tai),推行“二維碼”電子標簽(qian),實現危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)“來源可(ke)查、去(qu)向可(ke)追(zhui)、全程(cheng)留痕”。落實危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)政(zheng)務服(fu)務“不見面”辦理(li)(li)。鼓勵有條件(jian)的設(she)區(qu)市組織(zhi)轄區(qu)內的危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)相關企業安裝智(zhi)(zhi)(zhi)能(neng)終端設(she)備(bei),建(jian)立可(ke)視(shi)化(hua)(hua)、智(zhi)(zhi)(zhi)能(neng)化(hua)(hua)監控體(ti)(ti)系(xi)(xi),并(bing)接入省(sheng)危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)監管平臺(tai)。推動(dong)省(sheng)危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)監管平臺(tai)與(yu)省(sheng)交通運(yun)(yun)輸(shu)(shu)廳的危(wei)險(xian)(xian)(xian)貨物(wu)道路運(yun)(yun)輸(shu)(shu)安全監管系(xi)(xi)統、省(sheng)衛(wei)(wei)生(sheng)健康委(wei)的“智(zhi)(zhi)(zhi)慧(hui)衛(wei)(wei)監”系(xi)(xi)統數據共享對接,與(yu)稅(shui)務、公(gong)(gong)安、司法機關等部門信(xin)息互通共享。逐(zhu)步建(jian)立全領(ling)域、全方位(wei)、全過程(cheng)的危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)監管數據網絡和(he)危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)閉環監管治(zhi)理(li)(li)體(ti)(ti)系(xi)(xi)。配合國家推進危(wei)險(xian)(xian)(xian)廢(fei)(fei)物(wu)收集、運(yun)(yun)輸(shu)(shu)、利用、處置(zhi)網上交易平臺(tai)建(jian)設(she)和(he)第(di)三方支付試(shi)點工作。(省(sheng)生(sheng)態環境廳牽頭,省(sheng)發(fa)展改革(ge)委(wei)、省(sheng)財(cai)政(zheng)廳、省(sheng)交通運(yun)(yun)輸(shu)(shu)廳、省(sheng)衛(wei)(wei)生(sheng)健康委(wei)、省(sheng)稅(shui)務局(ju)、省(sheng)公(gong)(gong)安廳、省(sheng)法院、省(sheng)檢察(cha)院等參與(yu))
三、加強(qiang)危險(xian)廢物源頭管控
(五)加強危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)管(guan)理(li)。督(du)促產生固體廢物(wu)(wu)的單位(wei)落實危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)主體責任,依法(fa)依規(gui)開展危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)。組建(jian)省級危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)專家(jia)委員會,獨(du)立、科學、客觀、公(gong)正開展省內(nei)危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)報告異議評(ping)估(gu)工作(zuo)。強化危(wei)(wei)(wei)(wei)險(xian)(xian)廢物(wu)(wu)鑒(jian)(jian)別(bie)報告抽查(cha)復核和鑒(jian)(jian)別(bie)單位(wei)評(ping)價,建(jian)立省內(nei)鑒(jian)(jian)別(bie)單位(wei)評(ping)價管(guan)理(li)制度(du),嚴厲打擊鑒(jian)(jian)別(bie)報告失實、鑒(jian)(jian)別(bie)檢測數(shu)據造假(jia)等違法(fa)違規(gui)行為。各縣(市、區(qu))人(ren)民政府應依法(fa)承擔轄區(qu)內(nei)涉(she)及突發環(huan)境事件(jian)、非(fei)法(fa)轉(zhuan)移(yi)傾倒或歷史(shi)遺(yi)留等無法(fa)追溯責任主體的固體廢物(wu)(wu)鑒(jian)(jian)別(bie)和處(chu)理(li)工作(zuo),確(que)保(bao)固體廢物(wu)(wu)科學、及時(shi)以及規(gui)范處(chu)理(li)。(省生態環(huan)境廳牽頭,省公(gong)安廳、省市場監管(guan)局等參與)
(六)嚴(yan)(yan)格項目(mu)準入(ru)。支(zhi)持以省內產生(sheng)的危(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)為原料(liao)的利(li)(li)用(yong)處(chu)置(zhi)項目(mu),依(yi)法(fa)(fa)(fa)依(yi)規從嚴(yan)(yan)審批省內利(li)(li)用(yong)處(chu)置(zhi)能力嚴(yan)(yan)重過剩的新建(jian)(jian)項目(mu),以及(ji)所(suo)需危(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)原料(liao)運輸距離長、環(huan)境(jing)風險(xian)(xian)大(da)、利(li)(li)用(yong)價值低(di)的綜(zong)合利(li)(li)用(yong)新建(jian)(jian)項目(mu),騰出環(huan)境(jing)容量(liang)優先(xian)保障生(sheng)態(tai)發(fa)展效益好的地區(qu)、領域(yu)和(he)企(qi)業。依(yi)法(fa)(fa)(fa)依(yi)規對重點行業企(qi)業建(jian)(jian)設項目(mu)“三同時”落實及(ji)建(jian)(jian)設項目(mu)竣工環(huan)境(jing)保護(hu)驗收(shou)情況進行核查。對危(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)產生(sheng)種(zhong)類(lei)、數量(liang)以及(ji)利(li)(li)用(yong)處(chu)置(zhi)方(fang)式與環(huan)境(jing)影響評價文件(jian)嚴(yan)(yan)重不一致的,督促相(xiang)關企(qi)業按相(xiang)關法(fa)(fa)(fa)律法(fa)(fa)(fa)規和(he)環(huan)境(jing)影響評價指南等(deng)文件(jian)要求(qiu)整改。鼓(gu)勵危(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)年產生(sheng)量(liang)6000噸以上的企(qi)業在環(huan)境(jing)風險(xian)(xian)可(ke)控的前提下自建(jian)(jian)利(li)(li)用(yong)處(chu)置(zhi)設施,實現(xian)危(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)內部資源化(hua)利(li)(li)用(yong)或無害化(hua)處(chu)置(zhi)。對產品附加值高(gao)的鈀(ba)鉑銠等(deng)貴金屬催化(hua)劑回收(shou)項目(mu),按規定(ding)放寬(kuan)原料(liao)管控要求(qiu)。(省生(sheng)態(tai)環(huan)境(jing)廳負(fu)責)
四、加強危險廢物收集轉運等過程(cheng)監管
(七)推動(dong)收(shou)集(ji)(ji)(ji)貯存轉(zhuan)(zhuan)運(yun)專業(ye)化(hua)。全(quan)面推進危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)收(shou)集(ji)(ji)(ji)轉(zhuan)(zhuan)運(yun)體系建(jian)設(she)(she)(she)。(省(sheng)(sheng)(sheng)生(sheng)態(tai)環境廳(ting)、省(sheng)(sheng)(sheng)交通運(yun)輸(shu)廳(ting)、省(sheng)(sheng)(sheng)衛生(sheng)健康委、省(sheng)(sheng)(sheng)教育廳(ting)等按職責分工(gong)負(fu)責)深入推進生(sheng)活垃圾分類,建(jian)立有害垃圾收(shou)集(ji)(ji)(ji)轉(zhuan)(zhuan)運(yun)體系,按危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)貯存污(wu)染控制(zhi)標準要求(qiu)統籌規劃建(jian)設(she)(she)(she)有害垃圾集(ji)(ji)(ji)中貯存點(dian)。(省(sheng)(sheng)(sheng)住(zhu)房城鄉(xiang)建(jian)設(she)(she)(she)廳(ting)牽頭,相關部(bu)門參與)持(chi)(chi)續落實(shi)(shi)廢(fei)鉛蓄(xu)電池集(ji)(ji)(ji)中收(shou)集(ji)(ji)(ji)和(he)跨區域轉(zhuan)(zhuan)運(yun)制(zhi)度,鼓(gu)勵廢(fei)礦(kuang)物(wu)(wu)油(you)處(chu)理企業(ye)開展廢(fei)礦(kuang)物(wu)(wu)油(you)收(shou)集(ji)(ji)(ji)網絡建(jian)設(she)(she)(she)試點(dian)工(gong)作(zuo)。持(chi)(chi)續推動(dong)小微企業(ye)危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)收(shou)集(ji)(ji)(ji)試點(dian),支持(chi)(chi)危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)專業(ye)收(shou)集(ji)(ji)(ji)轉(zhuan)(zhuan)運(yun)和(he)利用(yong)處(chu)置單位建(jian)設(she)(she)(she)區域性(xing)收(shou)集(ji)(ji)(ji)網點(dian)和(he)貯存設(she)(she)(she)施(shi),開展小微企業(ye)、科研機(ji)構、學(xue)校和(he)在線監測運(yun)維單位等產生(sheng)危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)的收(shou)集(ji)(ji)(ji)轉(zhuan)(zhuan)運(yun)服務。鼓(gu)勵化(hua)工(gong)等工(gong)業(ye)園(yuan)區配套(tao)建(jian)設(she)(she)(she)危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)集(ji)(ji)(ji)中貯存、預(yu)處(chu)理和(he)利用(yong)處(chu)置設(she)(she)(she)施(shi)。加強高校和(he)科研院(yuan)所實(shi)(shi)驗室危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)源頭分類管理,鼓(gu)勵開展實(shi)(shi)驗室危(wei)(wei)(wei)(wei)(wei)險(xian)(xian)廢(fei)物(wu)(wu)預(yu)處(chu)理和(he)收(shou)集(ji)(ji)(ji)轉(zhuan)(zhuan)運(yun)試點(dian)工(gong)作(zuo)。(省(sheng)(sheng)(sheng)生(sheng)態(tai)環境廳(ting)、省(sheng)(sheng)(sheng)交通運(yun)輸(shu)廳(ting)、省(sheng)(sheng)(sheng)教育廳(ting)等按職責分工(gong)負(fu)責)
