《中(zhong)華人(ren)民共(gong)和國鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)法(修訂(ding))》:鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)是國家重要基礎設(she)施(shi)、國民經(jing)濟大動脈和重要民生工程。現行《中(zhong)華人(ren)民共(gong)和國鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)法》頒布于1990年,對促進鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)發(fa)(fa)(fa)(fa)展發(fa)(fa)(fa)(fa)揮了重要作(zuo)用(yong)。三十年來,我國鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)發(fa)(fa)(fa)(fa)生了巨大變(bian)化(hua),鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)發(fa)(fa)(fa)(fa)展取得(de)了顯(xian)著(zhu)成(cheng)就(jiu)。鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)政企分(fen)(fen)開(kai)改(gai)革持續深(shen)入(ru)推(tui)進,鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)管理體制(zhi)發(fa)(fa)(fa)(fa)生重大變(bian)革;鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)投(tou)融資(zi)體制(zhi)改(gai)革加快(kuai)推(tui)進,合資(zi)鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)快(kuai)速發(fa)(fa)(fa)(fa)展,鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)市場(chang)逐步開(kai)放;鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)路(lu)(lu)(lu)(lu)(lu)(lu)網規(gui)模持續擴大,沿線外部(bu)環境日(ri)趨復雜;鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)與其(qi)他運輸(shu)方(fang)式的(de)(de)銜(xian)接越(yue)(yue)來越(yue)(yue)緊密(mi),在綜合交(jiao)通運輸(shu)體系中(zhong)發(fa)(fa)(fa)(fa)揮著(zhu)越(yue)(yue)來越(yue)(yue)重要的(de)(de)作(zuo)用(yong)。為了適應鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)改(gai)革發(fa)(fa)(fa)(fa)展新(xin)形(xing)勢、新(xin)要求,通過全(quan)面修訂(ding)本法,及時將鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)政企分(fen)(fen)開(kai)改(gai)革以來的(de)(de)成(cheng)功做法和經(jing)驗上升為法律規(gui)定,推(tui)動鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)全(quan)面融入(ru)綜合立體交(jiao)通網絡體系,促進鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)與其(qi)他運輸(shu)方(fang)式有效銜(xian)接,嚴守鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)安全(quan)發(fa)(fa)(fa)(fa)展底(di)線,鼓(gu)勵引導各類投(tou)資(zi)主體依(yi)法投(tou)資(zi)建設(she)、經(jing)營鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu),促進鐵(tie)(tie)(tie)(tie)路(lu)(lu)(lu)(lu)(lu)(lu)運輸(shu)市場(chang)化(hua)改(gai)革。
3.推動(dong)(dong)《中(zhong)(zhong)華(hua)人(ren)民(min)共和(he)國(guo)(guo)民(min)用(yong)航空(kong)(kong)法(fa)(修(xiu)訂)》《無(wu)人(ren)駕駛(shi)航空(kong)(kong)器(qi)(qi)飛(fei)(fei)行(xing)(xing)(xing)(xing)管(guan)理暫行(xing)(xing)(xing)(xing)條(tiao)例》頒布實施(shi)。修(xiu)訂《中(zhong)(zhong)華(hua)人(ren)民(min)共和(he)國(guo)(guo)民(min)用(yong)航空(kong)(kong)法(fa)》,適應民(min)航管(guan)理體(ti)制改(gai)革、國(guo)(guo)內外(wai)安(an)全(quan)(quan)形(xing)勢、國(guo)(guo)際公約轉化(hua)要求,保(bao)障民(min)用(yong)航空(kong)(kong)活動(dong)(dong)安(an)全(quan)(quan)有序(xu)開展(zhan)(zhan),維(wei)護民(min)用(yong)航空(kong)(kong)活動(dong)(dong)當事人(ren)各(ge)方權益,促(cu)進民(min)用(yong)航空(kong)(kong)事業持續(xu)健(jian)康高質量發展(zhan)(zhan)。制定《無(wu)人(ren)駕駛(shi)航空(kong)(kong)器(qi)(qi)飛(fei)(fei)行(xing)(xing)(xing)(xing)管(guan)理暫行(xing)(xing)(xing)(xing)條(tiao)例》,規范無(wu)人(ren)駕駛(shi)航空(kong)(kong)器(qi)(qi)飛(fei)(fei)行(xing)(xing)(xing)(xing)相關活動(dong)(dong),促(cu)進行(xing)(xing)(xing)(xing)業健(jian)康發展(zhan)(zhan),切實維(wei)護國(guo)(guo)家安(an)全(quan)(quan)、公共安(an)全(quan)(quan)、飛(fei)(fei)行(xing)(xing)(xing)(xing)安(an)全(quan)(quan)。

《中(zhong)華人民共和國(guo)(guo)海(hai)商(shang)法(fa)(fa)(fa)(修訂)》:現行《中(zhong)華人民共和國(guo)(guo)海(hai)商(shang)法(fa)(fa)(fa)》于1993年正(zheng)式(shi)實施,至今已28年。當(dang)前(qian),我(wo)國(guo)(guo)國(guo)(guo)民經(jing)濟(ji)發展水(shui)平、經(jing)濟(ji)貿易形(xing)態(tai)、航運(yun)產業結(jie)構(gou)、國(guo)(guo)際國(guo)(guo)內法(fa)(fa)(fa)律環(huan)境等已發生巨大、深(shen)刻(ke)變化,《中(zhong)華人民共和國(guo)(guo)海(hai)商(shang)法(fa)(fa)(fa)》構(gou)建的(de)法(fa)(fa)(fa)律制度已滯(zhi)后于發展。通過修訂本法(fa)(fa)(fa),分析(xi)我(wo)國(guo)(guo)航運(yun)、貿易的(de)利益訴求,總結(jie)海(hai)事司法(fa)(fa)(fa)的(de)有(you)益經(jing)驗,吸收海(hai)商(shang)法(fa)(fa)(fa)理論研究的(de)先進成果(guo),借鑒國(guo)(guo)際海(hai)商(shang)立(li)法(fa)(fa)(fa)發展經(jing)驗,為維護航運(yun)、貿易各方(fang)正(zheng)當(dang)權益,維護航運(yun)經(jing)濟(ji)秩序,維護海(hai)洋權益,保護海(hai)洋環(huan)境提供(gong)法(fa)(fa)(fa)律保障(zhang)。
3.加快(kuai)民(min)用航(hang)空(kong)器(qi)事故(gu)調查(cha)條(tiao)例(li)立法進程。適(shi)應民(min)航(hang)發展新形(xing)勢,完善民(min)用航(hang)空(kong)器(qi)事故(gu)調查(cha)法規制(zhi)度,防(fang)止和減少民(min)用航(hang)空(kong)器(qi)事故(gu)。“十四(si)五”時期要完成民(min)用航(hang)空(kong)器(qi)事故(gu)調查(cha)條(tiao)例(li)起草工作(zuo),形(xing)成草案送(song)審(shen)稿報(bao)送(song)國務院。
4.加(jia)快《中華人民共和國港(gang)(gang)口(kou)(kou)法(fa)(修訂(ding))》立法(fa)進程。就港(gang)(gang)口(kou)(kou)管(guan)理(li)(li)體制、港(gang)(gang)口(kou)(kou)工程建設管(guan)理(li)(li)、港(gang)(gang)口(kou)(kou)生產安(an)全管(guan)理(li)(li)、港(gang)(gang)口(kou)(kou)運輸保(bao)障義務、港(gang)(gang)口(kou)(kou)綠色發(fa)展及岸線管(guan)理(li)(li)、港(gang)(gang)口(kou)(kou)資源(yuan)整合等方面進行修訂(ding)完善,促進航運業取(qu)得新發(fa)展。“十四五(wu)”時期要完成《中華人民共和國港(gang)(gang)口(kou)(kou)法(fa)(修訂(ding))》起草工作,形成草案送審稿報送國務院。
5.加(jia)快《中華(hua)(hua)人民共(gong)(gong)和國(guo)(guo)海(hai)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)安(an)全(quan)法(fa)》配套法(fa)規立(li)法(fa)進程。修訂《中華(hua)(hua)人民共(gong)(gong)和國(guo)(guo)船舶和海(hai)上(shang)(shang)(shang)設(she)施(shi)檢(jian)(jian)(jian)驗(yan)條例(li)》,適應船舶檢(jian)(jian)(jian)驗(yan)體(ti)制(zhi)改革和商漁(yu)船檢(jian)(jian)(jian)驗(yan)融合(he)發展形勢,借鑒國(guo)(guo)際(ji)船舶檢(jian)(jian)(jian)驗(yan)管理經驗(yan),對船檢(jian)(jian)(jian)體(ti)制(zhi)和監管模式(shi)等(deng)法(fa)律制(zhi)度進行調(diao)(diao)整(zheng)和完(wan)(wan)善(shan)。將現行《中華(hua)(hua)人民共(gong)(gong)和國(guo)(guo)海(hai)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)事故(gu)調(diao)(diao)查(cha)處(chu)理條例(li)》修訂為水(shui)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)事故(gu)調(diao)(diao)查(cha)處(chu)理條例(li),規范內河和海(hai)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)事故(gu)報(bao)告、調(diao)(diao)查(cha)、處(chu)理、調(diao)(diao)解等(deng),確保(bao)水(shui)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)安(an)全(quan)。“十四(si)五”時期要完(wan)(wan)成《中華(hua)(hua)人民共(gong)(gong)和國(guo)(guo)船舶和海(hai)上(shang)(shang)(shang)設(she)施(shi)檢(jian)(jian)(jian)驗(yan)條例(li)(修訂)》、水(shui)上(shang)(shang)(shang)交(jiao)通(tong)(tong)(tong)事故(gu)調(diao)(diao)查(cha)處(chu)理條例(li)起(qi)草工作(zuo),形成草案送審稿報(bao)送國(guo)(guo)務院。
(三)準確把握經濟社會和交通運(yun)輸發展規律(lv),切實深化(hua)法律(lv)法規項(xiang)目前(qian)瞻性、儲備性研(yan)究。
1.加強跨運(yun)輸方式立(li)法研(yan)究(jiu)儲備。開展綜(zong)合(he)交通運(yun)輸樞紐(niu)條(tiao)例立(li)法研(yan)究(jiu),為建立(li)綜(zong)合(he)交通運(yun)輸基礎設(she)施與樞紐(niu)建設(she)法律制度、規范多層級一體化的綜(zong)合(he)交通樞紐(niu)系統提(ti)供(gong)法規支撐。
2.加強安(an)(an)(an)(an)全(quan)(quan)應(ying)急(ji)保障立法(fa)(fa)研究(jiu)(jiu)(jiu)(jiu)儲備(bei)。研究(jiu)(jiu)(jiu)(jiu)完善交通(tong)運輸應(ying)急(ji)救援相(xiang)關法(fa)(fa)律(lv)制(zhi)度,針對自然災(zai)(zai)害、事(shi)故(gu)災(zai)(zai)難(nan)、公共衛生事(shi)件(jian)和(he)社會(hui)安(an)(an)(an)(an)全(quan)(quan)事(shi)件(jian)等突發(fa)事(shi)件(jian),根(gen)據不同運輸方式應(ying)急(ji)管(guan)(guan)理(li)特點,在相(xiang)關法(fa)(fa)律(lv)、法(fa)(fa)規中(zhong)補充完善應(ying)急(ji)救援相(xiang)關法(fa)(fa)律(lv)制(zhi)度。研究(jiu)(jiu)(jiu)(jiu)修訂《鐵(tie)路(lu)安(an)(an)(an)(an)全(quan)(quan)管(guan)(guan)理(li)條(tiao)例(li)(li)(li)》,完善高鐵(tie)安(an)(an)(an)(an)全(quan)(quan)法(fa)(fa)律(lv)制(zhi)度,健(jian)全(quan)(quan)鐵(tie)路(lu)沿線安(an)(an)(an)(an)全(quan)(quan)環境綜(zong)合治理(li)法(fa)(fa)律(lv)機(ji)制(zhi),確保鐵(tie)路(lu)安(an)(an)(an)(an)全(quan)(quan)暢通(tong)。研究(jiu)(jiu)(jiu)(jiu)修訂《中(zhong)華人民(min)共和(he)國內河(he)交通(tong)安(an)(an)(an)(an)全(quan)(quan)管(guan)(guan)理(li)條(tiao)例(li)(li)(li)》,并研究(jiu)(jiu)(jiu)(jiu)適(shi)時上(shang)升為內河(he)交通(tong)安(an)(an)(an)(an)全(quan)(quan)法(fa)(fa),提升內河(he)交通(tong)安(an)(an)(an)(an)全(quan)(quan)水(shui)(shui)(shui)(shui)平。研究(jiu)(jiu)(jiu)(jiu)制(zhi)定(ding)水(shui)(shui)(shui)(shui)上(shang)人命(ming)搜尋救助條(tiao)例(li)(li)(li)、沉船打(da)撈(lao)清除(chu)(chu)管(guan)(guan)理(li)條(tiao)例(li)(li)(li)、潛水(shui)(shui)(shui)(shui)條(tiao)例(li)(li)(li),規范(fan)水(shui)(shui)(shui)(shui)上(shang)人命(ming)搜尋救助及沉船打(da)撈(lao)清除(chu)(chu)活動,維護潛水(shui)(shui)(shui)(shui)作業市場秩序,提升水(shui)(shui)(shui)(shui)上(shang)交通(tong)應(ying)急(ji)管(guan)(guan)理(li)能(neng)力。研究(jiu)(jiu)(jiu)(jiu)修訂《中(zhong)華人民(min)共和(he)國航(hang)道管(guan)(guan)理(li)條(tiao)例(li)(li)(li)》,適(shi)應(ying)航(hang)道發(fa)展(zhan)需求,規范(fan)改善通(tong)航(hang)條(tiao)件(jian)、保障航(hang)道暢通(tong)和(he)航(hang)行安(an)(an)(an)(an)全(quan)(quan)。研究(jiu)(jiu)(jiu)(jiu)修訂《中(zhong)華人民(min)共和(he)國民(min)用航(hang)空(kong)器適(shi)航(hang)管(guan)(guan)理(li)條(tiao)例(li)(li)(li)》,研究(jiu)(jiu)(jiu)(jiu)起草民(min)用航(hang)空(kong)飛行標準條(tiao)例(li)(li)(li),確保民(min)航(hang)飛行安(an)(an)(an)(an)全(quan)(quan)。
3.加強交通(tong)運(yun)輸市場監管立法研(yan)(yan)(yan)究(jiu)儲(chu)備。研(yan)(yan)(yan)究(jiu)起草鐵路運(yun)輸條例(li),建立健全鐵路運(yun)輸基(ji)本制(zhi)度(du)規(gui)范,規(gui)范鐵路運(yun)輸行(xing)為和(he)運(yun)輸市場秩序。研(yan)(yan)(yan)究(jiu)修(xiu)訂(ding)(ding)《中(zhong)(zhong)華人民(min)共和(he)國(guo)船(chuan)(chuan)(chuan)(chuan)舶登(deng)記(ji)(ji)條例(li)》,加強船(chuan)(chuan)(chuan)(chuan)舶安(an)全監督和(he)規(gui)范船(chuan)(chuan)(chuan)(chuan)舶登(deng)記(ji)(ji)行(xing)為的要求,明(ming)確登(deng)記(ji)(ji)內容、性(xing)質、融資(zi)租賃登(deng)記(ji)(ji)、自貿區(港)國(guo)際航行(xing)船(chuan)(chuan)(chuan)(chuan)舶登(deng)記(ji)(ji)制(zhi)度(du)等。研(yan)(yan)(yan)究(jiu)修(xiu)訂(ding)(ding)《中(zhong)(zhong)華人民(min)共和(he)國(guo)船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)條例(li)》,并研(yan)(yan)(yan)究(jiu)適時上升為船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)法,規(gui)范船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)任職(zhi)(zhi)資(zi)格、船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)職(zhi)(zhi)責(ze)、船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)職(zhi)(zhi)業保(bao)障、船(chuan)(chuan)(chuan)(chuan)員(yuan)(yuan)培訓和(he)服(fu)務。研(yan)(yan)(yan)究(jiu)修(xiu)訂(ding)(ding)《中(zhong)(zhong)華人民(min)共和(he)國(guo)國(guo)際海運(yun)條例(li)》,深(shen)化(hua)國(guo)際海運(yun)市場“放管服(fu)”改革。研(yan)(yan)(yan)究(jiu)修(xiu)訂(ding)(ding)《中(zhong)(zhong)華人民(min)共和(he)國(guo)郵政法實施(shi)細則》,優化(hua)郵政領域審批相關制(zhi)度(du)安(an)排(pai)。
4.加(jia)強綠色交(jiao)通(tong)發(fa)展立(li)法研(yan)究(jiu)儲備(bei)。研(yan)究(jiu)修訂《防治船(chuan)(chuan)舶污染(ran)海洋(yang)環境管(guan)理(li)條例》,進(jin)一(yi)步理(li)順部門職責,規范(fan)防治船(chuan)(chuan)舶及其有關作業活動污染(ran)海洋(yang)環境的(de)管(guan)理(li)和應急處理(li),實現(xian)與國際公(gong)約的(de)有效對接。探索開展交(jiao)通(tong)運輸(shu)行業節約能源、新能源汽車(che)推廣應用、促(cu)進(jin)新能源船(chuan)(chuan)舶和清潔能源發(fa)展相關立(li)法研(yan)究(jiu)。
