湖南省(sheng)強化危(wei)險廢物監管和(he)利用處置能力改革(ge)實施(shi)方案

為切(qie)實提升危險(xian)廢物監管(guan)和利用處置能(neng)力,有效防范危險(xian)廢物環境與安全風險(xian),根據《中華人民共(gong)和國(guo)固體廢物污染環境防治法》《國(guo)務院辦公廳關于印發強化危險(xian)廢物監管(guan)和利用處置能(neng)力改革實施方案(an)的通知》等(deng)法律法規和政策文(wen)件,結合我省實際(ji),特制定(ding)本方案(an)。

一、總體(ti)要求

(一)指導思想。以習(xi)近(jin)平(ping)(ping)新時代中國特色社會主義思想(xiang)為指導,全面貫徹(che)黨的二十(shi)大精神,深入(ru)貫徹(che)落(luo)實習(xi)近(jin)平(ping)(ping)生態文(wen)明思想(xiang)和(he)(he)習(xi)近(jin)平(ping)(ping)總(zong)書(shu)記對湖(hu)南重(zhong)要(yao)講話重(zhong)要(yao)指示批示精神,緊緊圍繞(rao)省委、省政府“三高四新”戰(zhan)略定位和(he)(he)使命任務,深入(ru)打好污染防治(zhi)攻(gong)堅(jian)戰(zhan),以防范環境與安(an)全風險(xian)(xian)(xian)為目(mu)標,以持(chi)續改(gai)善生態環境質量(liang)為核心,優化頂層設計、深化監(jian)管體制(zhi)機制(zhi)改(gai)革,堅(jian)持(chi)精準治(zhi)污、科(ke)學(xue)治(zhi)污、依法治(zhi)污,持(chi)續提升(sheng)危(wei)險(xian)(xian)(xian)廢物環境監(jian)管能(neng)力(li)、利用(yong)處置能(neng)力(li)和(he)(he)風險(xian)(xian)(xian)防范能(neng)力(li),維(wei)護人民群眾身體健康和(he)(he)生態環境安(an)全。

(二(er))工作原則。

堅持(chi)改革創(chuang)新(xin),先行示(shi)范。全面深化監管體制(zhi)(zhi)機(ji)制(zhi)(zhi)改革,創(chuang)新(xin)方式方法,激發市場活力,推動危險廢物污染(ran)環境防(fang)治先行示(shi)范。

堅持科(ke)(ke)學(xue)統籌(chou),補齊短板。統籌(chou)就(jiu)近處理(li),通過(guo)科(ke)(ke)學(xue)評估、合理(li)布局、優化結(jie)構,推(tui)動(dong)危(wei)險廢(fei)物源頭(tou)減量(liang)化、過(guo)程資(zi)源化、處置無害化,補齊醫(yi)療廢(fei)物、危(wei)險廢(fei)物收(shou)集處理(li)設施(shi)方(fang)面短板。

堅持多(duo)元共管,保障民生。完善危(wei)險(xian)廢物(wu)監管跨(kua)部(bu)門聯動機制,強化政府引導與(yu)支持,壓(ya)實企(qi)業、園區、部(bu)門責任(ren),充分發揮社(she)會(hui)組(zu)織和公眾(zhong)監督作用,推動解(jie)決(jue)影響群眾(zhong)身(shen)邊的涉危(wei)險(xian)廢物(wu)污染問題,有效(xiao)維護(hu)群眾(zhong)切身(shen)利益。

(三)總體目(mu)標。進(jin)一步完(wan)善危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)環境監(jian)管(guan)體(ti)制(zhi)機(ji)制(zhi),建立安(an)全監(jian)管(guan)與(yu)環境監(jian)管(guan)聯(lian)動機(ji)制(zhi),有效(xiao)遏制(zhi)危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)環境違法(fa)行為。基(ji)本補齊醫療(liao)廢(fei)物(wu)(wu)、危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)收集處(chu)(chu)理設施(shi)短(duan)板,縣級(ji)以上(shang)(shang)城市(shi)建成區醫療(liao)廢(fei)物(wu)(wu)無(wu)害化處(chu)(chu)置(zhi)率達99%以上(shang)(shang),全省危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)利用(yong)處(chu)(chu)置(zhi)能力基(ji)本滿足本行政區域內的處(chu)(chu)理需求(qiu)。到2025年底,建立“源頭嚴防(fang)、過程(cheng)嚴管(guan)、后果(guo)嚴懲(cheng)”危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)監(jian)管(guan)體(ti)系;危(wei)險(xian)(xian)(xian)(xian)廢(fei)物(wu)(wu)利用(yong)處(chu)(chu)置(zhi)能力充(chong)分(fen)保障,技術(shu)和運營水平(ping)持(chi)續提升。

二、落實危險廢物管理職(zhi)責

(四)壓實政(zheng)府和部門責任。嚴(yan)格落(luo)實“黨(dang)政(zheng)同(tong)(tong)責(ze)(ze)(ze)、一(yi)崗雙責(ze)(ze)(ze)”,將危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)污染環(huan)(huan)(huan)(huan)境(jing)防(fang)(fang)(fang)治工(gong)(gong)(gong)作(zuo)納(na)入(ru)國民經濟和社會(hui)發展規劃、生(sheng)態環(huan)(huan)(huan)(huan)境(jing)保(bao)護規劃。各市(shi)州、縣市(shi)區(qu)(qu)人民政(zheng)府將危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)污染環(huan)(huan)(huan)(huan)境(jing)防(fang)(fang)(fang)治情況(kuang)納(na)入(ru)環(huan)(huan)(huan)(huan)境(jing)狀況(kuang)和環(huan)(huan)(huan)(huan)境(jing)保(bao)護目標完(wan)成(cheng)(cheng)情況(kuang)年度(du)(du)報告,并向本級人民代表(biao)(biao)大(da)會(hui)或者(zhe)人民代表(biao)(biao)大(da)會(hui)常務委員(yuan)會(hui)報告。對做出(chu)顯著成(cheng)(cheng)績(ji)的依(yi)(yi)法給(gei)予表(biao)(biao)彰(zhang),對不(bu)履(lv)(lv)行危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)監(jian)管責(ze)(ze)(ze)任(ren)的依(yi)(yi)法追(zhui)責(ze)(ze)(ze)。(省(sheng)生(sheng)態環(huan)(huan)(huan)(huan)境(jing)廳(ting)(ting)牽頭(tou),省(sheng)直相關(guan)單(dan)位按職責(ze)(ze)(ze)分(fen)工(gong)(gong)(gong)負(fu)(fu)責(ze)(ze)(ze),各市(shi)州、縣市(shi)區(qu)(qu)人民政(zheng)府負(fu)(fu)責(ze)(ze)(ze)落(luo)實,以下(xia)均需各市(shi)州、縣市(shi)區(qu)(qu)政(zheng)府負(fu)(fu)責(ze)(ze)(ze)落(luo)實,不(bu)再列出(chu))建立和完(wan)善危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)污染環(huan)(huan)(huan)(huan)境(jing)防(fang)(fang)(fang)治目標責(ze)(ze)(ze)任(ren)制和考(kao)核評價(jia)制度(du)(du),將目標完(wan)成(cheng)(cheng)情況(kuang)作(zuo)為考(kao)核評價(jia)黨(dang)政(zheng)領(ling)導班子和有(you)關(guan)領(ling)導干部(bu)的重要參考(kao)。(省(sheng)生(sheng)態環(huan)(huan)(huan)(huan)境(jing)廳(ting)(ting)牽頭(tou),省(sheng)委組織部(bu)等(deng)參與)發展改革(ge)、工(gong)(gong)(gong)業和信息(xi)化、生(sheng)態環(huan)(huan)(huan)(huan)境(jing)、自然資(zi)源、住房城(cheng)鄉建設、交通運輸、應(ying)急(ji)管理(li)、農(nong)業農(nong)村(cun)、衛生(sheng)健(jian)康、公(gong)安、海關(guan)等(deng)有(you)關(guan)部(bu)門,按照職責(ze)(ze)(ze)分(fen)工(gong)(gong)(gong)嚴(yan)格履(lv)(lv)行其在危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)利用(yong)處置(zhi)、污染防(fang)(fang)(fang)治、安全生(sheng)產、運輸安全及衛生(sheng)防(fang)(fang)(fang)疫等(deng)方面的監(jian)管職責(ze)(ze)(ze),強(qiang)化工(gong)(gong)(gong)作(zuo)協同(tong)(tong)聯動,對不(bu)履(lv)(lv)行危(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)監(jian)管責(ze)(ze)(ze)任(ren)或監(jian)管不(bu)到(dao)位的,依(yi)(yi)法嚴(yan)肅追(zhui)究責(ze)(ze)(ze)任(ren)。(省(sheng)發展改革(ge)委、省(sheng)工(gong)(gong)(gong)業和信息(xi)化廳(ting)(ting)、省(sheng)生(sheng)態環(huan)(huan)(huan)(huan)境(jing)廳(ting)(ting)、省(sheng)自然資(zi)源廳(ting)(ting)、省(sheng)住房城(cheng)鄉建設廳(ting)(ting)、省(sheng)交通運輸廳(ting)(ting)、省(sheng)應(ying)急(ji)廳(ting)(ting)、省(sheng)農(nong)業農(nong)村(cun)廳(ting)(ting)、省(sheng)衛生(sheng)健(jian)康委、省(sheng)公(gong)安廳(ting)(ting)等(deng)按職責(ze)(ze)(ze)分(fen)工(gong)(gong)(gong)負(fu)(fu)責(ze)(ze)(ze))

(五)強化(hua)園區管理責任。進(jin)一步強化工(gong)業園(yuan)(yuan)區(qu)(qu)管(guan)理(li)職(zhi)責(ze),將危(wei)險(xian)廢物(wu)(wu)(wu)污染環境防治工(gong)作納入年度(du)評價重要(yao)內容。園(yuan)(yuan)區(qu)(qu)管(guan)理(li)機構應分級分類(lei)動(dong)態建立(li)危(wei)險(xian)廢物(wu)(wu)(wu)重點監管(guan)清(qing)單;探(tan)索環保(bao)(bao)管(guan)家(jia)駐點協(xie)助管(guan)理(li)模式,定期深入排(pai)查(cha)環境隱(yin)患(huan)、科學評估園(yuan)(yuan)區(qu)(qu)內企(qi)業危(wei)險(xian)廢物(wu)(wu)(wu)產生種類(lei)與數量及園(yuan)(yuan)區(qu)(qu)集(ji)中收集(ji)貯存處(chu)理(li)設施(shi)存在的環境風險(xian),打通危(wei)險(xian)廢物(wu)(wu)(wu)資源利(li)用(yong)(yong)園(yuan)(yuan)區(qu)(qu)小(xiao)循環,保(bao)(bao)障園(yuan)(yuan)區(qu)(qu)危(wei)險(xian)廢物(wu)(wu)(wu)利(li)用(yong)(yong)處(chu)置能力。(省生態環境廳、省發展改(gai)革委等按職(zhi)責(ze)分工(gong)負(fu)責(ze),各工(gong)業園(yuan)(yuan)區(qu)(qu)負(fu)責(ze)落實)

(六)落實企業主體(ti)責任。危險(xian)(xian)廢(fei)(fei)物(wu)產(chan)生、收集、貯存(cun)、運輸、利用、處置單位(以下統(tong)稱“危險(xian)(xian)廢(fei)(fei)物(wu)相關(guan)單位”)是(shi)危險(xian)(xian)廢(fei)(fei)物(wu)污染環(huan)境防(fang)治和安全(quan)生產(chan)法(fa)定責(ze)(ze)(ze)任主體,其主要負責(ze)(ze)(ze)人(ren)(ren)(法(fa)定代表人(ren)(ren)、實際控制人(ren)(ren))是(shi)第一責(ze)(ze)(ze)任人(ren)(ren),嚴格執行相關(guan)法(fa)律法(fa)規與規章制度。(省(sheng)(sheng)生態環(huan)境廳(ting)、省(sheng)(sheng)衛生健康(kang)委、省(sheng)(sheng)公安廳(ting)、省(sheng)(sheng)交(jiao)通(tong)運輸廳(ting)、省(sheng)(sheng)應(ying)急廳(ting)等按職(zhi)責(ze)(ze)(ze)分工負責(ze)(ze)(ze))危險(xian)(xian)廢(fei)(fei)物(wu)相關(guan)企(qi)業依法(fa)及時公開危險(xian)(xian)廢(fei)(fei)物(wu)污染環(huan)境防(fang)治信息,依法(fa)依規投(tou)保環(huan)境污染責(ze)(ze)(ze)任保險(xian)(xian)。(省(sheng)(sheng)生態環(huan)境廳(ting)、湖南(nan)銀保監局等按職(zhi)責(ze)(ze)(ze)分工負責(ze)(ze)(ze))

三、突出危險廢物源(yuan)頭管控

(七)嚴格環境準入。嚴格落實“三線一單”管控(kong)、危(wei)險(xian)廢物(wu)污(wu)染(ran)環境防治設施“三同時”管理和工(gong)(gong)業(ye)(ye)危(wei)險(xian)廢物(wu)排(pai)污(wu)許可(ke)(ke)制度等(deng)(deng)要求,依(yi)法依(yi)規對已(yi)批復(fu)的重(zhong)點(dian)行(xing)業(ye)(ye)涉危(wei)險(xian)廢物(wu)建(jian)(jian)設項(xiang)目環境影響評價(jia)文件開展復(fu)核,對年產危(wei)廢量大(da)于500噸的重(zhong)點(dian)行(xing)業(ye)(ye)(有色(se)金(jin)屬(shu)冶煉、有色(se)金(jin)屬(shu)礦(kuang)采選、化工(gong)(gong)、電解錳、電鍍、制革、石油加工(gong)(gong)等(deng)(deng))建(jian)(jian)設項(xiang)目的排(pai)污(wu)許可(ke)(ke)、環保竣工(gong)(gong)驗(yan)收等(deng)(deng)文件開展抽(chou)查核查。(省生態(tai)環境廳負責)

(八)推進源(yuan)頭減量。支持研發、推廣(guang)減(jian)(jian)少危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)產(chan)(chan)生量(liang)(liang)和降(jiang)低(di)危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)危(wei)(wei)(wei)害性的(de)生產(chan)(chan)工(gong)藝(yi)及設備,從源頭上(shang)減(jian)(jian)少危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)產(chan)(chan)生量(liang)(liang)、降(jiang)低(di)危(wei)(wei)(wei)害性;不(bu)斷提升(sheng)危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)經(jing)營單位清潔生產(chan)(chan)水(shui)平;鼓勵產(chan)(chan)生危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)以及涉危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)工(gong)業(ye)(ye)園區依法自(zi)行(xing)處置危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu),年(nian)產(chan)(chan)危(wei)(wei)(wei)廢(fei)(fei)量(liang)(liang)大于2萬噸的(de)工(gong)業(ye)(ye)園區、年(nian)產(chan)(chan)危(wei)(wei)(wei)廢(fei)(fei)量(liang)(liang)大于5千噸的(de)新建(jian)、擴(kuo)建(jian)工(gong)業(ye)(ye)企業(ye)(ye)應配(pei)套建(jian)設危(wei)(wei)(wei)險(xian)(xian)廢(fei)(fei)物(wu)(wu)(wu)自(zi)行(xing)處理設施;打造一批有色冶煉(lian)、鋼(gang)鐵、化工(gong)等(deng)(deng)行(xing)業(ye)(ye)綠色示范企業(ye)(ye)。(省工(gong)業(ye)(ye)和信(xin)息化廳、省發展改革委、省科技廳、省生態環境廳等(deng)(deng)按職責分工(gong)負(fu)責)

(九(jiu))推(tui)動鑒別鑒定。強化危險(xian)(xian)廢(fei)物(wu)(wu)產(chan)生企業鑒(jian)別(bie)主體責(ze)任,督促企業及(ji)時對(dui)(dui)定(ding)性不明的副(fu)產(chan)物(wu)(wu)等物(wu)(wu)料(liao)進(jin)行(xing)主動鑒(jian)別(bie),嚴格執行(xing)《國家危險(xian)(xian)廢(fei)物(wu)(wu)名錄》和危險(xian)(xian)廢(fei)物(wu)(wu)鑒(jian)別(bie)相關(guan)規定(ding),對(dui)(dui)環(huan)境風險(xian)(xian)小的危險(xian)(xian)廢(fei)物(wu)(wu)實行(xing)特定(ding)環(huan)節豁免(mian)管(guan)理(li),開展(zhan)危險(xian)(xian)廢(fei)物(wu)(wu)鑒(jian)別(bie)試(shi)點。(省生態環(huan)境廳牽頭,省市場監管(guan)局等按職責(ze)分工負(fu)責(ze))

(十)嚴格轉移管理。嚴格執行《湖南省危險廢物跨省轉入利用管理辦法(試行)》,嚴禁將已納入跨省轉入“黑名單”管理類別的危險廢物轉入省內利用,簡化納入“白名單”管理類別的危險廢物轉入審批程序。(省生態環境廳牽頭,省公安廳、省交通運輸廳等參與)

四、加強危險(xian)廢(fei)物收(shou)集貯(zhu)存轉運體系建設(she)

(十一)規范危險廢(fei)物(wu)貯存(cun)設(she)施。新建(jian)項目(mu)應結(jie)合(he)(he)危廢產生量、貯(zhu)(zhu)存(cun)周期等,配(pei)套建(jian)設符合(he)(he)規范要(yao)(yao)求的貯(zhu)(zhu)存(cun)場所,嚴格按照《危險廢物貯(zhu)(zhu)存(cun)污(wu)染(ran)控制標準》建(jian)設,嚴格執行分類分區(qu)貯(zhu)(zhu)存(cun)要(yao)(yao)求。(省生態環(huan)境(jing)廳負責)

(十三)健全醫療廢物收運體(ti)系。推進農村及偏遠地區(qu)醫療廢物(wu)收集體(ti)系(xi)建(jian)設(she),綜合考慮地理位(wei)置(zhi)(zhi)分布、服務人口(kou)、滿足平時及應急需求等因(yin)素,優化區(qu)域性收集、中(zhong)轉(zhuan)或處置(zhi)(zhi)醫療廢物(wu)設(she)施。(省(sheng)發展改(gai)革委、省(sheng)生態(tai)環(huan)境(jing)廳(ting)、省(sheng)衛生健康委、省(sheng)公安廳(ting)、省(sheng)交通運(yun)輸廳(ting)、省(sheng)應急廳(ting)等按職責分工負責)

五、強化(hua)廢棄化(hua)學(xue)品監管

(十(shi)四)協同推動(dong)廢棄危險化學(xue)品(pin)監管。健全危(wei)(wei)(wei)險(xian)化(hua)學品報廢(fei)管(guan)(guan)理(li)制度(du),建(jian)(jian)立(li)廢(fei)棄(qi)危(wei)(wei)(wei)險(xian)化(hua)學品的(de)信(xin)息登記檔(dang)案。應急(ji)管(guan)(guan)理(li)部門(men)(men)和生(sheng)態環境部門(men)(men)以及其他相關部門(men)(men)建(jian)(jian)立(li)監管(guan)(guan)協作和聯(lian)合執法工作機制,推動信(xin)息及時、充分(fen)、有效共享(xiang)。按照危(wei)(wei)(wei)險(xian)廢(fei)物規范化(hua)環境管(guan)(guan)理(li)要求,加強對從事(shi)收集、貯存、轉移(yi)、利用、處置廢(fei)棄(qi)危(wei)(wei)(wei)險(xian)化(hua)學品經營(ying)活動單位(wei)的(de)監管(guan)(guan)。(省生(sheng)態環境廳(ting)(ting)、省公安廳(ting)(ting)、省交通(tong)運輸(shu)廳(ting)(ting)、省應急(ji)廳(ting)(ting)等(deng)按職責分(fen)工負責)
