生態環境部近日修訂發布了《規劃環境影響評價技術導則 產業園區》(HJ 131-2021)(以下簡稱《規劃環評導則 產業園區》)。為全面深入了解《規劃環評導則 產業園區》的主要內容、實施重點,記者采訪了生態環境部環評司有關負責人,對《規劃環評導則 產業園區》進行了詳細解讀。

問:《規劃環評導則 產業(ye)園(yuan)區(qu)》修訂(ding)的背景(jing)和意義是什(shen)么?

答:2003年9月(yue)1日實施的《中華人(ren)民(min)共和(he)(he)(he)國環(huan)(huan)境(jing)影響(xiang)(xiang)評(ping)價(jia)法》(以下(xia)簡稱《環(huan)(huan)評(ping)法》)確立了規(gui)(gui)劃環(huan)(huan)境(jing)影響(xiang)(xiang)評(ping)價(jia)制度。《開(kai)發(fa)區區域環(huan)(huan)境(jing)影響(xiang)(xiang)評(ping)價(jia)技術(shu)導(dao)(dao)則》(HJ/T 131-2003)(以下(xia)簡稱“2003版導(dao)(dao)則”)作為環(huan)(huan)評(ping)法配套(tao)規(gui)(gui)章之一,是繼《規(gui)(gui)劃環(huan)(huan)境(jing)影響(xiang)(xiang)評(ping)價(jia)技術(shu)導(dao)(dao)則(試(shi)行)》(HJ/T 130-2003)之后的第二個規(gui)(gui)劃環(huan)(huan)境(jing)影響(xiang)(xiang)評(ping)價(jia)行業標準,在當時的背(bei)景和(he)(he)(he)條件下(xia),規(gui)(gui)范和(he)(he)(he)指導(dao)(dao)了我國開(kai)發(fa)區區域環(huan)(huan)評(ping)。

為(wei)適(shi)應新(xin)形勢生態(tai)(tai)文明(ming)建設和(he)環(huan)(huan)(huan)境(jing)(jing)保護新(xin)要(yao)求,《環(huan)(huan)(huan)評(ping)法》和(he)《規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)境(jing)(jing)影(ying)(ying)(ying)響(xiang)(xiang)評(ping)價(jia)技術導(dao)則 總(zong)綱》(以下簡稱《總(zong)綱》)均進行(xing)了多次(ci)修訂或修正(zheng)。同時,《“十三五”生態(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)保護規(gui)劃(hua)(hua)(hua)》《中共中央國務院關于(yu)全(quan)面加強(qiang)生態(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)保護堅(jian)決打(da)好污(wu)染(ran)防治攻堅(jian)戰的(de)意見》《關于(yu)進一步加強(qiang)產業(ye)園(yuan)區(qu)(qu)規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)境(jing)(jing)影(ying)(ying)(ying)響(xiang)(xiang)評(ping)價(jia)工(gong)作(zuo)(zuo)(zuo)的(de)意見》等對園(yuan)區(qu)(qu)規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)評(ping)工(gong)作(zuo)(zuo)(zuo)提(ti)(ti)(ti)出了新(xin)的(de)要(yao)求。2003版(ban)導(dao)則已不適(shi)應當前環(huan)(huan)(huan)境(jing)(jing)管理方式轉變、環(huan)(huan)(huan)境(jing)(jing)管理要(yao)求及園(yuan)區(qu)(qu)規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)評(ping)需求。為(wei)此,生態(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)部啟動了2003版(ban)導(dao)則的(de)修訂,并(bing)(bing)更名為(wei)《規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)境(jing)(jing)影(ying)(ying)(ying)響(xiang)(xiang)評(ping)價(jia)技術導(dao)則 產業(ye)園(yuan)區(qu)(qu)》,以提(ti)(ti)(ti)高(gao)導(dao)則的(de)針(zhen)對性和(he)可操作(zuo)(zuo)(zuo)性,并(bing)(bing)為(wei)進一步規(gui)范、加強(qiang)產業(ye)園(yuan)區(qu)(qu)規(gui)劃(hua)(hua)(hua)環(huan)(huan)(huan)評(ping)管理提(ti)(ti)(ti)供技術支撐。

問:與“2003版導則”相(xiang)比,《規劃環評導則 產業園區》有哪些突出特點?

答:修訂(ding)后的(de)《規(gui)劃(hua)環評導則(ze) 產(chan)業園區》是產(chan)業園區規(gui)劃(hua)環境影響(xiang)評價(jia)工作的(de)重要(yao)技術性指(zhi)導文(wen)件,較2003版導則(ze),主要(yao)有以下三方面突出特點(dian):

一(yi)是《規(gui)劃環評導(dao)則 產(chan)業(ye)園(yuan)區》兼(jian)顧技(ji)術(shu)(shu)標準統一(yi)性(xing)和差異性(xing)的關(guan)系,明確了(le)產(chan)業(ye)園(yuan)區規(gui)劃環評最(zui)基本、最(zui)普適的技(ji)術(shu)(shu)規(gui)定,突(tu)出(chu)(chu)了(le)對各類產(chan)業(ye)園(yuan)區的指導(dao)性(xing),對涉及易燃易爆和有(you)毒有(you)害危險物質、以重點碳排放(fang)行(xing)業(ye)為主導(dao)等類型園(yuan)區提出(chu)(chu)了(le)差異化技(ji)術(shu)(shu)要求(qiu),強調了(le)導(dao)則的實用(yong)性(xing)和可操(cao)作性(xing)。

二是《規(gui)(gui)劃環(huan)(huan)評(ping)導則 產(chan)業園(yuan)(yuan)區(qu)》準(zhun)(zhun)確把握技(ji)(ji)術標準(zhun)(zhun)與(yu)法規(gui)(gui)、政(zheng)策的關系(xi),落實生(sheng)態(tai)文(wen)明建(jian)設和“放(fang)管服”改革(ge)要(yao)求(qiu)、銜接區(qu)域生(sheng)態(tai)環(huan)(huan)境(jing)分(fen)區(qu)管控體系(xi)、強化(hua)規(gui)(gui)劃和項(xiang)目(mu)環(huan)(huan)評(ping)聯動(dong)、推動(dong)減污降碳協同共治,新增簡(jian)化(hua)入園(yuan)(yuan)建(jian)設項(xiang)目(mu)環(huan)(huan)境(jing)影響評(ping)價建(jian)議,以(yi)及(ji)園(yuan)(yuan)區(qu)環(huan)(huan)境(jing)準(zhun)(zhun)入、園(yuan)(yuan)區(qu)碳減排(pai)等技(ji)(ji)術要(yao)求(qiu),并將(jiang)生(sheng)態(tai)文(wen)明、高質量發(fa)展的目(mu)標導向轉化(hua)成技(ji)(ji)術要(yao)求(qiu),為實現園(yuan)(yuan)區(qu)高質量發(fa)展和環(huan)(huan)境(jing)高水平保護提供了技(ji)(ji)術方法。

三(san)是《規(gui)劃(hua)環評(ping)(ping)導(dao)則(ze) 產業園區》精準(zhun)把控在環評(ping)(ping)技(ji)術(shu)導(dao)則(ze)體系(xi)、環境(jing)管(guan)理體系(xi)中的定位,縱(zong)向上(shang)承接《總綱(gang)》、“三(san)線一單(dan)”要求,橫向上(shang)與環境(jing)要素(su)及(ji)專項環境(jing)影響評(ping)(ping)價(jia)技(ji)術(shu)導(dao)則(ze)相協調,著(zhu)力解決技(ji)術(shu)標(biao)準(zhun)體系(xi)、環境(jing)管(guan)理體系(xi)的傳導(dao)、協調、銜(xian)(xian)接等(deng)關(guan)鍵問題。完善了上(shang)下貫通、左右銜(xian)(xian)接的技(ji)術(shu)標(biao)準(zhun)體系(xi)構(gou)建,促進了各環評(ping)(ping)導(dao)則(ze)的協同發力。

問:《規劃(hua)環評導(dao)則 產業園區》重點修訂內容有哪些(xie)?

答(da):修訂(ding)后《規劃環評導(dao)則 產業園區》主要包括前言,以(yi)及試用(yong)范(fan)圍、規范(fan)性引用(yong)文件等15部分技術內容(rong),與現(xian)行(xing)導(dao)則相(xiang)比,修訂(ding)內容(rong)主要體現(xian)在以(yi)下幾方(fang)面:

一是適(shi)應園(yuan)(yuan)區(qu)環境管理需求,擴(kuo)大適(shi)用(yong)范(fan)圍。鑒于當前產業園(yuan)(yuan)區(qu)類(lei)(lei)型繁(fan)多(duo),各(ge)(ge)(ge)(ge)地管理實際(ji)情(qing)況各(ge)(ge)(ge)(ge)異,比如(ru)浙江的(de)產業集聚區(qu)、上(shang)海和廣東的(de)工業地塊等均比照(zhao)園(yuan)(yuan)區(qu)管理,有明確的(de)責任主體,修訂后的(de)《規劃(hua)環評(ping)(ping)導則(ze) 產業園(yuan)(yuan)區(qu)》擴(kuo)大了適(shi)用(yong)范(fan)圍,適(shi)用(yong)于《中國(guo)(guo)開發區(qu)審核公告目錄》的(de)各(ge)(ge)(ge)(ge)類(lei)(lei)法定園(yuan)(yuan)區(qu),即國(guo)(guo)務院(yuan)及(ji)省、自治(zhi)區(qu)、直轄市人民(min)政府批(pi)準設立的(de)產業園(yuan)(yuan)區(qu);國(guo)(guo)務院(yuan)有關部門批(pi)準設立的(de)各(ge)(ge)(ge)(ge)類(lei)(lei)園(yuan)(yuan)區(qu)、根據(ju)地方規定需要開展規劃(hua)環評(ping)(ping)的(de)其(qi)他各(ge)(ge)(ge)(ge)類(lei)(lei)產業園(yuan)(yuan)區(qu)可(ke)參照(zhao)執(zhi)行(xing)。

二是強調“協(xie)同聯動”,優化評(ping)(ping)價技術(shu)(shu)路徑(jing)。銜(xian)接(jie)(jie)《總綱》,針(zhen)對《規劃環評(ping)(ping)導則 產業(ye)園(yuan)區(qu)》承上啟下的(de)(de)(de)功能定位(wei),把握“聯”的(de)(de)(de)思路,技術(shu)(shu)流程(cheng)體現(xian)上下傳導的(de)(de)(de)架構銜(xian)接(jie)(jie)邏輯,向上銜(xian)接(jie)(jie)“三(san)(san)線(xian)一(yi)單(dan)”對園(yuan)區(qu)的(de)(de)(de)剛性約(yue)束,并融合至評(ping)(ping)價各環節;向下結(jie)合現(xian)狀調查、影響預測評(ping)(ping)價結(jie)果,基于(yu)區(qu)域(yu)“三(san)(san)線(xian)一(yi)單(dan)”,細化園(yuan)區(qu)環境(jing)準入,對建(jian)設(she)項(xiang)(xiang)目形(xing)成(cheng)剛性約(yue)束和(he)精準指(zhi)導。評(ping)(ping)價中通過結(jie)果與評(ping)(ping)價過程(cheng)的(de)(de)(de)反饋,全程(cheng)與規劃編(bian)制部(bu)門互動,開展公眾參(can)與工(gong)作,及時(shi)調整、修正各階(jie)段評(ping)(ping)價成(cheng)果,形(xing)成(cheng)閉(bi)環,保證評(ping)(ping)價結(jie)論(lun)的(de)(de)(de)科(ke)學性。為區(qu)域(yu)、園(yuan)區(qu)、建(jian)設(she)項(xiang)(xiang)目環境(jing)影響評(ping)(ping)價的(de)(de)(de)系(xi)統銜(xian)接(jie)(jie)和(he)協(xie)同管理,產業(ye)園(yuan)區(qu)規劃實施(shi)與區(qu)域(yu)生態環境(jing)質量目標、管理要(yao)求(qiu)的(de)(de)(de)動態銜(xian)接(jie)(jie)提供了技術(shu)(shu)保障。

三是深化(hua)環(huan)(huan)境(jing)污(wu)染(ran)防治(zhi),突(tu)出生(sheng)(sheng)態環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)改(gai)善(shan)(shan)核(he)(he)心。修訂后(hou)的(de)(de)《規劃環(huan)(huan)評(ping)導則(ze) 產(chan)業園區(qu)》圍(wei)繞(rao)園區(qu)生(sheng)(sheng)態環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)改(gai)善(shan)(shan)這(zhe)一核(he)(he)心目標,按(an)摸(mo)清現狀、找準問題(ti)(ti),預(yu)測(ce)(ce)影(ying)響(xiang)、明(ming)確趨勢(shi)、提(ti)出對(dui)策(ce),改(gai)善(shan)(shan)質(zhi)(zhi)(zhi)量(liang)、跟蹤監測(ce)(ce)、實施(shi)保障(zhang)的(de)(de)技(ji)術路(lu)徑展(zhan)開。現狀調(diao)查與(yu)評(ping)價(jia)專題(ti)(ti)通(tong)(tong)過(guo)調(diao)查、評(ping)價(jia)、溯源(yuan),厘(li)清環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)改(gai)善(shan)(shan)短板。環(huan)(huan)境(jing)影(ying)響(xiang)預(yu)測(ce)(ce)與(yu)評(ping)價(jia)專題(ti)(ti)通(tong)(tong)過(guo)預(yu)測(ce)(ce)新增(zeng)環(huan)(huan)境(jing)影(ying)響(xiang)、分析環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)變化(hua)趨勢(shi),明(ming)確了園區(qu)生(sheng)(sheng)態環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)改(gai)善(shan)(shan)方向。環(huan)(huan)境(jing)影(ying)響(xiang)減(jian)緩(huan)對(dui)策(ce)、措施(shi)與(yu)協同降碳專題(ti)(ti)從預(yu)防和治(zhi)理(li)兩個維度協同推(tui)進(jin),對(dui)園區(qu)既有環(huan)(huan)境(jing)問題(ti)(ti)及(ji)規劃方案實施(shi)后(hou)可能產(chan)生(sheng)(sheng)的(de)(de)不良(liang)環(huan)(huan)境(jing)影(ying)響(xiang),基于優化(hua)調(diao)整后(hou)的(de)(de)規劃方案,提(ti)出資源(yuan)節約與(yu)碳減(jian)排(pai)、園區(qu)環(huan)(huan)境(jing)風險(xian)防范對(dui)策(ce)、生(sheng)(sheng)態環(huan)(huan)境(jing)保護與(yu)污(wu)染(ran)防治(zhi)對(dui)策(ce)和措施(shi),以(yi)推(tui)進(jin)生(sheng)(sheng)態環(huan)(huan)境(jing)質(zhi)(zhi)(zhi)量(liang)的(de)(de)改(gai)善(shan)(shan)。

四是(shi)突出園(yuan)區特色,新增環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)評價(jia)防(fang)(fang)控(kong)、強化基(ji)礎設施評價(jia)優化等技(ji)術要(yao)求。對(dui)涉及易(yi)燃易(yi)爆和有毒(du)有害(hai)危(wei)險(xian)(xian)(xian)物質(zhi)的(de)(de)園(yuan)區,按環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)現狀調查、預測與評價(jia)、風(feng)險(xian)(xian)(xian)防(fang)(fang)控(kong)的(de)(de)技(ji)術思(si)路(lu)開展環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)評價(jia)防(fang)(fang)控(kong)。重點關注環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)物質(zhi)、風(feng)險(xian)(xian)(xian)源及風(feng)險(xian)(xian)(xian)受體(ti)(ti)(ti)調查,各類突發(fa)性(xing)環(huan)(huan)(huan)境(jing)事(shi)件的(de)(de)環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)影(ying)響(xiang),以環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)預警體(ti)(ti)(ti)系(xi)建設、突發(fa)性(xing)環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)事(shi)故應急響(xiang)應、環(huan)(huan)(huan)境(jing)應急保(bao)障體(ti)(ti)(ti)系(xi)建設及與區域風(feng)險(xian)(xian)(xian)防(fang)(fang)控(kong)體(ti)(ti)(ti)系(xi)銜接為核心的(de)(de)環(huan)(huan)(huan)境(jing)風(feng)險(xian)(xian)(xian)防(fang)(fang)范(fan)對(dui)策(ce)。

突(tu)出污染集(ji)中治(zhi)理基(ji)本要求,基(ji)礎(chu)(chu)設(she)(she)(she)(she)(she)施(shi)關注類型擴展至(zhi)污水(shui)集(ji)中處(chu)理、固廢(含(han)危廢)集(ji)中處(chu)置、中水(shui)回用、集(ji)中供(gong)熱(供(gong)冷)、余熱利用、集(ji)中供(gong)氣(qi)(含(han)蒸汽)、供(gong)水(shui)、供(gong)能(neng)(含(han)清潔低碳(tan)能(neng)源供(gong)應(ying))等(deng)設(she)(she)(she)(she)(she)施(shi);調查、分析內容進(jin)一步深化(hua),包括基(ji)礎(chu)(chu)設(she)(she)(she)(she)(she)施(shi)規模(mo)、布(bu)局、服(fu)務范圍、處(chu)理工(gong)藝(yi)、處(chu)理能(neng)力、實際運行效(xiao)果、達標排(pai)放及(ji)配(pei)(pei)套(tao)管網(wang)建(jian)(jian)設(she)(she)(she)(she)(she)等(deng);根據(ju)環(huan)境可(ke)行性論(lun)證,對可(ke)能(neng)產生重大不良環(huan)境影響,或無法滿(man)足規劃(hua)實施(shi)需求、難(nan)以有效(xiao)實現園區污染集(ji)中治(zhi)理的基(ji)礎(chu)(chu)設(she)(she)(she)(she)(she)施(shi)建(jian)(jian)設(she)(she)(she)(she)(she)方案,提出選址(zhi)、規模(mo)、建(jian)(jian)設(she)(she)(she)(she)(she)時(shi)序及(ji)處(chu)理工(gong)藝(yi)、排(pai)污口(kou)設(she)(she)(she)(she)(she)置、提標改(gai)造、中水(shui)回用及(ji)配(pei)(pei)套(tao)管網(wang)建(jian)(jian)設(she)(she)(she)(she)(she)等(deng)優化(hua)調整建(jian)(jian)議,或區域基(ji)礎(chu)(chu)設(she)(she)(she)(she)(she)施(shi)共建(jian)(jian)共享的建(jian)(jian)議。
